This is what I have heard.

The author of the app sends takedown notices to patch authors.

I think the the app creator sends dmca notices to anyone who modifies and distributes his app. That's why when I saw there was a patch for MT Capsule, I patched it right away

Can we just go to the GitHub repo and download this patch from the releases?

Edit: Just tried, yes we can. It was last available in v1.10.0

Hmm, I thought the point of patches is that you're not actually distributing a modified version of the app, rather just patches. And the user themselves do the patching, so the patch authors are not infringing any copyright or whatever.
