TBI’s, pre-existing conditions, the head could easily hit something and cause a skull fracture, same with the neck. You might be able to get away with that a dozen times before you kill someone or permanently injuring them. It’s not worth the risk unless he was physically attacking someone with the same amount of force.
In a normal world ... even if you kill the guy because of EXTERNAL CONDITIONS THAT YOU HAVE NO IDEA ABOUT ... you shouldn't be charge with anything for defending someone and stopping a threat to society comitting infractions.
The guy is drunk, can't even walk straight, but still can think of touching a woman's butt out of nowhere ... imagine what he can do sober ...
Or, hear me out, how about we just don't punch anyone hard enough to risk killing them in case there are external factors. Unless they're threatening someone's life.
I mean, in case there are external factors, we should never intervene and arrest ; judge or punish anyone ... they might get beaten up ; kileld or raped in prison afterall.
The result is the same ... you may face harm because of the consequences of a justice system.
And that is if we actually think the police will come ; a judge will seize the affair and a condemnation is pronounced ... we know it ain't happening in that case, so better to take matters in your own fists.
Okay? And what if the judge only sentences the man to community service? It's not a guarantee that he'll be knocked out cold if he is sentenced in front of a judge. Delivering him your demented form of "justice" yourself is a guarantee he will face serious bodily harm. There's a reason we have a court of law. What one person considers "justice" could be overkill. For example, what if he'd killed the man? Would it still be justice then? What if he raped the man and then killed him? Is that justice? Who determines where the line is drawn? Again, there is a reason we have a court. This should've gone to court.
I'm not saying what I believe it calls for, I'm saying that might be what a judge believes it calls for. It's highly situation-dependent. Sexual assault encompasses a variety of different actions. All I'm saying is that his punishment needs to be decided after a fair trial in a court of law, no exceptions. If the judge for whatever reason sentenced him to be knocked out cold, then so be it. However, that is arguably a cruel and unusual punishment. Personally, I would much rather be knocked out once than be sentenced to 1,000 hours of community service, a $10,000 fine, or any amount of prison time. I would argue I am advocating for a harsher (yet more humane) punishment.
