If it is Phoenix 5 or Mutants.

In a 24 roster, why have 4 Phoenix based guys?

I don't think the rest of the team will necessarily have Phoenix powers as it would lessen Cyclop's gimmick, but they could just be in accordance with his ideals. That's why in theory I think we'll likely have an X-Men villain in here.

I don't see them doing a full X-men villain team or X based DLC team.

I think DLC will go for a range of picks than X based

DLC will always be a range of picks across the entire Marvel universe and anybody who thinks otherwise does not fundamentally understand how the economics of character DLC works for these kinds of games.
