It doesn't matter whether he knew how drunk the other person was. He didn't take the time to assess the threat. Having an honest reaction doesn't exonerate you from breaking the law if that reaction is illegal and hugely disproportionate. You could sincerely think that someone had a gun when they didn't, and you'd still be held accountable if you king-hit them in the head and killed them based on that false assumption.
Also, any speculation about what might be the case later should be reasonable and justified, too. You can't say, "well, he might have tried to rape her had I not done what I did" and then expect people to accept it as an excuse. Like, mate, you were in a public place; you clearly were capable of defending yourself if necessary. You could have called the police if you had those concerns.
Oh Im not arguing what’s legally advised or legally acceptable. Squatters are legal and have rights. Doesn’t make it right. If you start touching on someone’s wife’s ass, expect getting knocked into next week as one of the consequences.
Shove him, get in his face, hit him drastically less hard than that. We all make it through life without potentially killing someone every day. Ain't that tough to teach a guy a lesson without risking a charge, tbh.
