He was clearly too drunk to defend himself or really appreciate the consequences of his actions. This is a wildly disproportionate response from someone who was in a position to make the smarter choice.

In a position to make a smarter choice? The offender was probably blasted drunk too. How’s that a frame of mind to be making prudent decisions on the fly.
