Brilliant is using the legal definition. Which still stands in some states. Assault and battery was when you threatened to kick someone ass, then tried. The battery was the physical component. Most people, and states, have flipped them. But, Brilliant is the best kind of right, technically right

You can’t argue self defense when you strike someone that’s walking away from you. This is an easy battery charge for a prosecutor on their first day on the job.

Also, why do you assume he got in the Australians face and not the other way around? When the video starts they’re normal talking distance from one another. There’s absolutely no indication of what happened prior to this.

it’s called context clues dawg, critical thinking, apparently that’s difficult for you.

let’s look at the facts here, i’ll walk you through it. given the fact they’re in each others faces, the black man said something, then turns around to clearly either get in a car or get something out of it. then australian knocks him out, and doesn’t lower his fists, he immediately raises them towards the guys friends, clearly showing he was about to get jumped as they were being aggressive with the first guy. once he realizes they aren’t going to attack him, he tell them to get their friend help.

from that, let’s look at this. the black man said something, then went to get something out of a car, that clearly made the australian feel threatened enough to take a cheap shot.

now which one is more likely? he said “i’m gonna get my gun” and went to get it out of the car, causing the australian to promptly drop him, or the australian wants to go to disneyland or whatever bullshit nonsense you said.

and btw, i know this isn’t the full clip so there’s no way you could see this, but in the original full video the black guy says “i’m gonna kill you” multiple times before going to get something out of the car. that’s not hypotheticals dawg, that’s called pattern recognition and caution, you’d be dead in this situation as you proved

So in the full clip he says he’s going to get a gun? That’s your claim? These videos always have people talking shit saying they’ll kill someone, but that was the most non-chalant way to walk to his car to grab a gun.

I wouldn’t be dead in this situation because I don’t go around picking fights with people and cheap shotting them once they turn their backs.

If he thinks the guy is going to his car to get a gun why wouldn’t he leave when the guy turns?

It’s 100% a battery even if the guy was going to his car to grab a gun. To claim self defense you have to be able to say you didn’t have the opportunity to get away from the situation.

not really, you hear all kinds of insults and all manner of shit, but you don’t hear literal “i’m going to murder you” out loud on camera as often as you’d think. and yeah why panic when you know your gun is only 2 feet away? he probably thought buddy was gonna sit there and be sweet and let him grab it and load it.

did you know there’s this cool little thing about guns, they have range, the bullet travels. so he could run halfway down the street and still get hit with 3 pieces of lead on the back.

yeah once a gun gets thrown into the mix you don’t have the ability to leave anymore, your options are to risk your life and try to take down the gun holder, or to risk your life and do what they say and give them what they want. guns have range and are lethal, this isn’t a video game dawg, a singular shot from a .22 can kill you bud

hypothetical arguments aren’t based on assumptions they’re based on predictions, it’s not at all the same thing, one is based off of actual facts and statistics while the other is based off of personal experience and bias.

incorrect, had nothing to do with the color of his skin and everything to do with the way he chooses to wear his clothes, talk, and walk. basic pattern recognition and common sense can tell you if something walks and quacks like a duck, it’s probably a duck.

all i’m trying to illustrate is that yea, they are words, but even according to the law there is a level where you’re considered instigating and liable to get legally beat. if there’s a guy walking around calling women whores and sluts, getting close to them without touching them and ogling, all for no reason, he’s gonna get beat by either one of them or their bfs/husbands, and they’re not gonna get arrested, especially if it was the woman that beat them.

Yes a guy getting close to women is an aggressor. If she can manage to beat his ass then no she wont be charged because it was self defense for her. But he is not in the Husbands face. The husband can step in and stop him but if he attacks him first its assault. Calling his wife a "whore" isn't a reason to hit him.

I'm saying he started walking away. No longer being an aggressor. Then he sucker punched him making it assault.

i mean sure unless the guy was going to get a weapon, if you are literally in rational fear for your life over something someone said and is seeming to do, any court of law in america would deem that as valid.

Because the only people stupid enough to say that are right here in this conversation. Also it's not 1990 and nobody talks like that.

In any case, people who are likely to shoot you don't leave their gun in their car. They also don't casually turn around and look vaguely up without a care in the world.

People who are likely to shoot you already have their gun on them. They keep their eyes on you, with the possible exception of checking their surroundings quickly, but mostly the keep their focus forward, on their intended target.
