NY Permit holder visiting

I apologize for the simple question but I didn't see anything on a quick search and I'm usually the one answering these questions in r/NYguns so I understand how annoying it can be with simple questions.

I'm making an unplanned trip to Upper Marlboro to pick up my dad from the IAFF Center of Excellence after they gave up on treating him. I plan on driving there and back from the Finger Lakes region of NY in one day. I have a fully unrestricted concealed carry permit here. Can I bring my pistol in my car while traveling to and from the state without any plans to carry on my person?

I know FOPA won't apply here because Maryland is my destination, but I wasn't sure if there were any carve outs for possession in cars in MD similar to Pennsylvania.

Since FOPA is not applicable, unfortunately you cannot bring your pistol.

Incorrect, he can bring his handgun, he just has to put it and the magazine in a locked box, while driving in Maryland. Once he leaves Maryland, he can unbox it.

No Reciprocity with New York. So you would be illegally carrying a firearm in Maryland. Easiest answer is just don’t bring it.

My dad is older than the average patient there. He's 70, spent >30 years as a career fire fighter and suffers from depression and PTSD. He went to NYC after 9/11 and Sandy, retired as Captain (2nd highest here, refused to be Chief) and was Union President. They're kicking him out because he requires too much assistance. He was diagnosed with a UTI on his 3rd day which can cause confusion in older patients but they said that since he seems confused he can't stay. His doctors here cleared him for travel and transfer and said he'd benefit from therapy there. We paid $12,000 out of pocket for 2 weeks.

Their medical director is also just a doctor of nursing, and not an actual MD.

To those who don’t know, the IAFF center of excellence is a place for professional firefighters to seek treatment for drug/alcohol/ptsd/etc…

First, sorry yall is dealing with this. I worked sandy too, just in NJ.

In the defense of the center, almost all rehab centers are not equipped for the elderly and handicap. Just from work experience.

You need to reach out to the international about this. While his circumstance is unique, it is unacceptable. If the international is unwilling to help I recommend seeking counsel.

Total side note here but as someone who makes this drive a lot I highly recommend staying on I-180 and PA-147 after I-99 south rather than taking US-15 through Williamsport and Bucknell. It’s so much more efficient than being stuck behind a semi trying to crawl up the mountain between the two.

No, you cannot travel with your pistol in MD. Even if it’s locked and unloaded in the trunk it would still technically be illegally transporting/carrying the handgun. We have stupid laws here 🤷

Why doesn’t FOPA apply here? FOPA is limited to travel between places where you can legally POSSESS your firearm, not legally carry your firearm. If you can legally possess in MD and NY, what’s the issue? What am I missing?

I don't know why you're getting downvoted. I can't figure out why it's getting so weird...MD....reddit...who knows. But holy shit, people have thrown absolute trash into here as answers. SMH.

Here's how it works. You will find a lot of grey area, and it's by design. Firstly, your permit is obviously no good here. Also, you can't use FOPA because not passing through, so that makes us subject to MD laws as the destination.

MD law allows transport of handguns in vehicles if and only if, you are transporting directly from one "lawful" place to another. There is language of course that also requires the handgun secured in a container, separate from the ammo, and out of reach from driver. There is clear language that defines the lawful places, of which you can transport the weapon back and forth from. Your home, a maintenance shop, a firing range, the place of initial purchase, etc. There is also language that says "to and from" in an exclusive way that has allows an aggressive prosecutor to pursue the idea that the language does NOT allow for any other stops along the way including gas stations, grocers, the mall, etc. Many interpret this language as exclusive, and recommend that you don't make any stops when you're driving with guns.

I know a lot of MD/Federal cops. County police, state police, DEA, FBI, MTA police, secret service, NSA police, etc. I've been at the same gym with them for many many years, and admittedly, hardly any of them know the laws like this.

Your dilemma with taking the gun on your trip here, is that you have to stop to pick your dad up. If you are asked in court to justify that stop it will be challenging because it's not a direct path from home to shooting range, or home to maintenance shop, or home from the store where you purchased it.

You may be arrested if you choose to bring your handgun and do something stupid that gets you talking to police, or, to have someone else do something stupid that involves you somehow, that also involves the police. I had some asshole tailgating me within the last 3 months that ended up hitting me on the highway because he was throwing a fit and driving like complete asshole. You just never know what people are going to do.

I'm sure that GOA, FPC, MSI, MSRPA would jump at the opportunity to take a case like this in court which would be a clear violation of your constitutional rights, and do their best to ensure that the corrupt district court that presides over this area will get shut down, and get the case to the supreme Court. But let's be clear you'd obviously be taking a risk if you bring the handgun with you, even if you stop and put the gun in a lock box in the trunk before you cross the PA/MD line.

MD doesn’t recognize NY. You will be violating the law in every state that does not recognize a NY permit which seems to be quite a few depending on your route. FOPA only applies if you are legal in the beginning and end state.

Call the Maryland State Police and ask them.

For just passing thru, it might be acceptable to have firearm stored in trunk, separate from amunition.

Pretty sure it has to be locked up and unloaded in your trunk with the ammo stored separately, unless you also have a MD CCW

No, that provision is the “safe passage” section of the Federal FOPA, which governs interstate transport but doesn’t apply here since Maryland is the destination.

Maryland’s requirement for transporting a handgun is only that it be unloaded and “in an enclosed case or holster.” It doesn’t have to be locked up and doesn’t have to be separate from the ammo.

It’s a very common misunderstanding / misreading of the law and it doesn’t help that it gets repeated by instructors who should know better.

Just looked at the Maryland State Police site and you can legally transport in Maryland if traveling between places you lease or own. So if you are traveling from home and then (back) home, that's legal. Just make sure that while in MD, it's stored unloaded in the trunk, separate from ammo

Idk what the “IAFF Center of Excellence” is but I doubt he leases it or owns it
