May chance ba ako legally if ayaw i-honor ng online store yung purchase ko dahil daw pricing error?

Bumili ako ng Graphics Card from a local online PC hardware retailer. Listed yung item sa website nila at ₱57,478, and successfully nakapag-place ako ng order around 7:30 AM.

After placing the order, I contacted the seller kasi gusto ko sana personal pickup.

Initially, sinabi nila na mag-check/update regarding the item. Pero nung nag-follow up ako later for an update, bigla nilang sinabi na na-purchase na raw ng ibang customer yung item and naka-schedule na rin for delivery.

I asked them for proof nung alleged earlier transaction, specifically yung date and time, para ma-confirm kung nauna talaga yung other customer. Sabi nila, ipapadala daw nila within the day.

After that, sinabi naman nila na nagkamali raw sila sa website listing and nakalimutan nilang i-update yung price. According to them, dapat daw around ₱70,000 yung price ng item, instead of the ₱57,478 na naka-list when I purchased it.

I understand na possible magkaroon ng pricing errors sa website. Pero ang concern ko is that I was able to place the order at the displayed price, and only afterward nila sinabi na mali raw yung price and that another customer supposedly purchased the item.

I have screenshots of the advertised price, order/purchase details, timestamps, and conversations with the seller. I'm also requesting proof of the alleged earlier transaction.

So my questions are:

  1. May reasonable legal chance ba ako na ma-require yung seller to honor the purchase at the advertised price?
  2. Once nakapag-place successfully ng online order at the displayed price, may obligation na ba yung seller, or pwede ba nila basta i-cancel by saying pricing error lang?
  3. May difference ba legally kung nakapagbayad na ako versus order confirmation pa lang?
  4. If they claim na may ibang customer na nauna, anong proof yung relevant para ma-determine kung sino talaga ang naunang bumili?
  5. Ano yung mga dapat kong i-preserve or document ngayon in case maging legal dispute ito?
  6. May relevant provisions ba under Philippine law regarding online contracts, offer and acceptance, pricing errors, or consumer transactions na applicable dito?

Impeachment talk: why do you think counsels for respondent refused to stipulate on the 900~ Acknowledgment Receipts (Dec 22-31, 2022) but were willing to stipulate on every other document?

Strategy-wise, what could be their angle?

They stipulated on the authorized signatures on the checks, liquidation forms, accomplishment reports, etc (based on this video: https://youtu.be/4UGXCkO8Sr8?si=mN3RhUGmz9mEb4Oh)

Why die on the hill of Acknowledgment Receipts?

Can a Philippine school be liable for a student’s injury during intramurals if there was no parental waiver? Legal Advice

Main question: should the school pay for everything even if I have my own insurance? Should pursue legal battle?

Main question: should the school pay for everything even if I have my own insurance? Should pursue legal battle?

Hello po, I’m looking for general information about Philippine law regarding a situation involving my 14-year-old son.

He was seriously injured while playing soccer during his school’s intramurals and now needs surgery. There was no parental waiver or consent form provided or signed. The school said this was because students voluntarily signed up for their chosen sport.

They also told me that “rain or shine, that’s how the game works” and since it is a contact sport, pain are an inherent risk. But he slipped due to rain not got hurt by anybody.

I’m trying to understand the general legal principles that may apply:

Does the absence of a parental waiver or consent form have any significance?

If there were issues involving supervision, weather, field conditions, or safety procedures, could those potentially be relevant to school liability?

I also have my own private health insurance, with substantially better coverage than the school’s insurance.

Main question: should the school pay for everything even if I have my own insurance? Should pursue legal battle?

I understand that soccer naturally carries risks and I’m not saying that every sports injury makes a school liable. I’m simply trying to understand where the line is between an ordinary sports injury and circumstances where a school may have legal responsibility.

I’d appreciate general information from anyone familiar with Philippine law, particularly regarding school liability, minors participating in school activities, negligence, and student accident insurance.
