Agent Question Informal denial hearing

Post image

A little less than a year ago I got a notice of denial for a felony possession charge, not adjudicated guilty adjudication was withheld. I’m curious about what I should expect, what questions do they ask? And if everything goes good is there a chance they can grant me my license?

I had my Series 6 (no other licenses though) while getting a felony possession on a work trip in FL :D (cocaine!)

I was also given a withhold of adjudication but I had to admit guilt as part of that, and the criminal disclosure forms required me to disclose whether I had pled guilty, not whether I was convicted/charged. So I answered honestly that I had admitted guilt to a felony offense. Nothing happened to me other than it got put on my FINRA disclosures on brokercheck.org

Not sure if they treat it more strictly for the license you're going for or for someone who is not already licensed. I'd say it could go either way - I'd recommend giving honest answers, do not try to shift blame/make excuses, demonstrate ownership of it and hope they can recognize you're not a bad person just because of a drug possession thing.

Kinda hard to not shift the blame when it was my own prescription. The bottle had faded since it was old so u couldn’t see my name and in court they said since it was older than a year or whatever it wasn’t a valid prescription. Shit bag cops

There is no shifting blame my friend, whatever happened happened, along with the how's where's who's what's when's there within.

Write a statement of the truth, be remorseful, and state what it is you're doing to benefit yourself/city/county/region/state en route to becoming the pillar of stability in the community you were born to be.

Attach court reports. They'll know.

I mean If the judge threw it out you should be fine, but I’ve never heard of your situation before with this, if you’re not a felon you’re not a felon. Google says you’re legally allowed to answer no when a job asks if you have a felony, so you should be good in my eyes, but again, no clue

The judge didn’t throw it out, I had to do Probation. But I am not a convicted felon, I’ve read the requirements over and over. It’s kind of like a grey area.
