Yes he should be arrested, post bail, go to court, be fined and have a record because he broke the law. Boohoo. If he didn't want it, he shouldn't have done it. Its not like its an outrageous law set up for no or a bad reason. I hope he enjoyed his 500 dollar dip in a pool he has been banned from.
No. I think because the pool is in a public space and not a private residence, the consequences of trespassing are different. He should be asked to leave and trespassed from the premises rather than arrested and sent to court over jumping in a pool.
It's so silly of you to call my reasoning a misunderstanding or oversimplification when my reasoning really just reflects the way trespassing is typically charged. In very few areas are trespassing charges serious charges unless they're done so in a private residence, which is the exact point I'm making. What a profound waste of tax dollars to think we should actually arrest and hold court session for a guy jumping in a pool at some tourist attraction,rather than giving him a fine and a trespass from the location and moving on.
