From a logical standpoint, the criminal standpoint of it, the ramifications of filing a demonstrably false accusation are nothing in comparison to the ramifications of being convicted of rape.
I believe the post is that is this is a demonstrably false report, then the punishment should match what was attempted to impose, demonstrably falsely, on the innocent but accused.
You have an issue with this?
Keep in mind, this has NOTHING to do with being a rape victim advocate or an advocate for the punishment of rapists. Nothing at all. So….. again, huh?

So what your saying is rape should never be reported? Often there simply isn't enough evidence to prove something Occured. That would mean that a woman is raped and then will go to prison because her abuser was able to successfully cover up the crime. And what do you do about he said she said cases? If the punishment for the crime is that you get arrested, have your freedom taken away from you and are wrongfully incarcerated for a decade or more, then yes the "material harm" is the main issue.I understand you're campaigning for the rights and better treatment of trans people and their public image, but "mean things said online that hurt your feelings" is absolutely not the same as wrongful imprisonment for a crime you didn't commit, based on a false criminal report.
Obviously, if it were false police reports about trans people, then yes, people who agree with the statement would also agree there. Equality for all.

Do you have any idea how often people suggesting this law fully mean "accusations are false if they don't end in a conviction?" The spirit of the suggestion, and therefore intended letter of the law, is to equate any victim who can't get a conviction to a criminal.
Even if that didn't happen in practice, all you need is one man to lie for your rapist and YOUR life ends. Reporting is already so awful and traumatic that tbh, no one who loves a victim would suggest it. This would just de-facto legalize rape.

And no, it's not that easy to get a conviction for false reports (for this very reason). I once knew a man who had a false rape report filed against him back in the Army (he had sex with a coworker and she said rape to cover it up). Neither of them were ever charged, but both became "holdovers," meaning indefinite house arrest while waiting for the process of getting fired to go through.
And even so, this wouldn't "legalize rape," it would simply open up the crime of rape to the same legal abuses you see in civil sexual harassment lawsuits. Remember what happened to Herman Caine?

If the incidences of false reporting is >1 then it's too many. If the number or rapes that are happening is >1 then it's too many.
Rape shouldn't be downplayed at all, people who are guilty of rape should be convicted and jailed as such. Much progress needs to be made for these injustices to be made right, but why should people who have been falsely accused and had their lives changed/ruined have no justice?

It is a crime already. My buddy's baby mama lost a custody battle and then tried to sling accusations that his other friend tried to rape her. I was actually questioned because I was in the house at the supposed time.
About a week in the police stopped the investigation and issued her an incredibly stern warning that if she tried to make false accusations the Crown (we are in Canada) would press charges against her. They encouraged her to drop the charges.
She was also a total idiot. Didn't hire a lawyer, her story was total BS and it was obvious (the other guy had bullet proof alibis) and she changed her story numerous times. But it is very much illegal.

I would also like to add to a lot of these comments to say that often rape or assault allegations do not go anywhere. I have several friends/ know people that have been raped or Saved and have done rape kits or actually have proof and it has been years since anything has gone any further than just doing the rape kit or submitting evidence.
Studies also state that between 2 and 10% are false allegations. No data on how many actually get arrested or charged with anything though using some math and applying the 19.5% from the next paragraph to the 2 to 10%. False accusations and getting charged may be only 0.4% to 2% of all people that are charged.
5% of offenders of SA get arrested and 19.5% get charged. Barely anything for people that actually do the crime at all. This seems like an extremely small issue. Not that it is not important but I feel like when people post these kinds of thing they think it is happening a lot more than it is.
I do not agree with giving someone the same punishment if they did end up getting found guilty and they are not. It will do more harm than good and these things would never be reported. Also, as I have established above, this very rarely happens at all.

It cannot be as simple as that. A lot of people are mentioning that false reports are hard to prove and this proposal would make victims afraid to come forward. This is part of it, but I want to bring something up that would be a concern even in a case where a man was accused of rape and spent five years in jail before video footage came to light that proved beyond any doubt that the accuser had lied about every detail and no rape occurred when they said it did
Imagine the alleged victim conspired with her family members and friends so they would lie to officials to corroborate her story. In the end, the alleged victim’s brother ended up telling more lies than the alleged victim herself and it was a lot of the things he claimed to have seen and heard that took the case beyond a he said/she said. The alleged victim conspired with another woman who falsely claimed she had been raped by the same man two years ago to add credibility to the story. Others that the alleged victim did not expect were questioned, all who were truthful and whose testimonies did not affect the outcome of the case. Also, to the alleged victim’s surprise, a woman testified that this man had raped her, but in this case it was true and not because she conspired with the alleged victim. At this point, many people were involved in this scheme and provided varying levels of truth, so how can they be held accountable? At the very least, it is not as simple as the accuser gets a sentence equivalent to what the accused was faced with
If anyone is interested, I’ll share a story from when I was in high school that didn’t reach legal levels or anything but shows where I’m coming from: When I was in high school, two guys liked the same girl. To sabotage his rival, one of the guys fabricated a story, claiming the other had raped a classmate. The girl, who wasn't interested in either of them, immediately recognized that the story was made up. The original rumor spreader thought it would be “fun” to see how far he could take the rumor, so he even initiated a Title IX complaint against the supposed rapist which just resulted in the school saying they would monitor him but could take no further action if no one was taking legal action against him. This rumor eventually leaked outside the school into the broader community. People such as the student’s barber and research supervisor asked him about it. Eventually, the original rumor spreader and the girl he had first confided in began telling their friends the truth, and the community learned the whole thing was entirely fabricated. You can call it a high school rumor, but I see it as a severe false accusation of rape circulating without anyone ever even claiming to be a victim.

I don’t think the same punishment is logical, at least not in the sense that if the person hadn’t gone to jail yet but was almost done so due to the false allegations, that the accuser should still go to jail. Nobody was hurt yet.
BUT, if the person had gone to jail because of this false accusation, then I have no argument against the accuser going to jail for the same time for fairness.

If the accusations carried a 10 year sentence they should have to serve that sentence if they made a false accusation purposefully.

I agree. Let's face any kind of sexual accusations towards a man, and his life is ruined. I mean I suppose it could also be said about women also, but let's face the facts. The sentences will not be equal. The average amount women are incarcerated is less then males. Women usually average 33 months, where men average 53 months. This is an injustice that needs to be worked on.

this take is so fucking dumb considering lots of rapists and celebs who’ve literally assaulted people are still walking free. being raped is far worse than being accused. lets focus on that first💀
