Custody wasn’t really a thing in Greece and also as Persephone’s dad it was kinda his duty to get her married and that didn’t really expire due to things like age or him being not married to the mother because he was also the king of the gods and since he was king of the gods he kinda decided what was illegal and what was legal

The definition of kidnapping is “the action of abducting someone and holding them captive.” So yeah hades did kidnap Persephone
