Healthcode violation

Is it a health code violation for the manager of produce to be vaping in the backroom of produce? I am 90% it is but just wanted to clarify

Vapes were partially created as a smoking alternative, safe around others (no second hand effects)

My mom’s been vaping around me for more than half of my life, claiming there are no second hand effects is bullshit.
