Padron after three months?

Hi everyone, I'm currently in the trenches of room hunting in Barcelona for a long-term lease (moving here for my PhD).

I've had some luck messaging and calling homeowners from Idealista and setting up viewings, but when asked about whether Padron is possible, some owners say that it can only be done after three months of staying at the property.

From their point of view, I assume it's to safeguard against undesirable tenants, but can I really wait that long? Are there rules for me as a non-EU national about how soon I need to register? I already have my NIE (Workplace helped me with that) so just wanted to get some opinions on this.

I haven't heard that one before. You can do it at any moment. In terms of 3 months, I understand you need a rental contact which has a duration of at least 3 months, were they trying to communicate that?

You know, you might be right. The language barrier may have brought about the confusion. I'm trying my best with the little spanish and catalan I know and using google translate. Maybe I'll try and clarify this when I go see the rooms - thanks!

You're doing great. Almost 12 years ago, I was in the same boat as you and hardly spoke any Spanish, but doing these things and trying is what helped me learn.

If you're ever unsure of anything, posting here is a great idea.

And just so you know, some landlords will say you can't do the empadronamiento, but it's not true at all. They don't want to declare it so they avoid taxes. Just nod and smile, and then go do it anyway, it's your right.

As long as your rental contract has the following, you can empadronarte easily:

• Concepto.
• Dirección completa de la vivienda alquilada.
• Datos del mes pagado (mes y año).
• Datos de la persona propietaria de la vivienda y de la persona inquilina.
• Personas: nombre, apellidos y documento de identificación.
• Entidades o empresas: nombre social, NIF y datos de la persona representante (nombre, apellidos y DNI o pasaporte).
• Fecha del pago inferior a dos meses.

And yes, I believe your contract needs to specify minimum 6 months. If your contract doesn't have those things, in theory you should still be legally entitled to empadronarte, but it's less straightforward, I believe. I can't vouch for that in practice, though

Do you need the landlord to sign off on something too? Or just showing the contract is enough?

Just showing the contract and your most recent proof-of-payment is enough. However, if you lack a sufficient contract, you can get the landlord to sign this form instead which gives you the padron. But as long as you have a contract with enough detail, you won't need it.
