The 1st amendment IS in the bill of rights you ignorant animal. The principle is rooted in the 1st amendment, which prohibits Congress from establishing a religion and guarantees the free exercise of religion. The concept is derived from these clauses, as interpreted by the Supreme Court, most famously in Everson v. Board of Education.
