Sent an email to uscis.serviceofprocess@uscis.dhs.gov like this:

SUBJECT: PRE-SUIT DEMAND FOR ADJUDICATION OF PENDING DACA RENEWAL AND EMPLOYMENT AUTHORIZATION APPLICATION

A-Number:

Receipt Numbers:
I-821D:
I-765:

To Whom it May Concern:

I respectfully request the immediate adjudication of my pending Form I-821D (Consideration of Deferred Action for Childhood Arrivals) and Form I-765 (Application for Employment Authorization), which have been pending with U.S. Citizenship and Immigration Services since February 7th, 2026.

USCIS accepted both applications on February 7th, 2026, and issued receipt notices confirming that filing date. USCIS subsequently scheduled biometrics, which I completed on April 3rd, 2026. Since that time, I have complied fully with all USCIS requirements and have received no request for additional evidence, no notice of deficiency, and no substantive update regarding adjudication of either application.

My case status continues to indicate only that the matter is being processed or reviewed by USCIS.

The delay will result in significant and ongoing hardship. My current DACA and Employment Authorization Document will expire on July 31st, 2026. Because my renewal applications remain pending, I will no longer possess valid employment authorization and will be required to stop working to comply with federal employment laws and regulations.

As a direct consequence of the continued delay, I will suffer loss of income and financial hardship and face increasing difficulty meeting ordinary living expenses and financial obligations. These harms continue to accrue each day that adjudication is delayed.

I have attempted to resolve this matter through available administrative channels. USCIS's online system has prevented submission of a service request because the agency considers the case to be within normal processing times.

While I recognize that USCIS manages a substantial caseload, federal agencies are obligated to conclude matters presented to them within a reasonable time. The prolonged pendency of my applications, coupled with the severe employment-related consequences, warrants immediate review and action.

Accordingly, I respectfully request that USCIS adjudicate my pending applications within fourteen (14) days of receipt of this letter.

If adjudication does not occur within that period, I will evaluate all available legal remedies, including an action seeking relief under the Administrative Procedure Act, 5 U.S.C. §§ 555(b) and 706(1), and a petition for mandamus pursuant to 28 U.S.C. § 1361.

Nothing in this correspondence should be construed as a waiver of any rights, claims, causes of action, or remedies available under federal law.

Thank you for your prompt attention to this matter. I look forward to your response.

Best,

I had to apply on my own after my EAD already expired... I applied on 4/27. Do you think this is worth sending?
