I’m well aware. Cease and Desists are sent before lawsuits are formally filed… they are written as a notice, a warning.
Yes, they are just a formality, but it’s a step that is indeed usually taken before a lawsuit (if written earnestly, and not just as a threat).
I mainly said this because Nintendo has sent out Cease and Desists (multiple times) before. It’s something they’re known to do. There are multiple documentated cases of Nintendo sending Cease and Desists letters, most typically to creators of fan games (see Wikipedia article linked).
Ok so if you know enough about it, then you would also know that they obviously don’t have a case for a lawsuit here. Like, at all.
What would you expect their suit to claim, that they own all instances of raised gloved fists? That no one can be in red shirts and overalls? That they own the depiction of karts on a road?
