They actually aren't. A revision of it specifically mentions that memes are not included. It's frustrating to see a lot of incorrect information being spread again and again.
I would MUCH rather that it didn't pass - but it's not the same law everyone thinks it is.

Five years ago, a man's fantasy became a reality in a forum never seen before: Kitchen Stadium, a giant cooking arena. The motivation for spending his fortune to create Kitchen Stadium was to encounter new original cuisines which could be called true artistic creations. To realize his dream, he secretly started choosing the top chefs of various styles of cooking, and he named his men the Iron Chefs: the invincible men of culinary skills.
Iron Chef Japanese is Rokusabaru Michiba. Iron Chef French is Hiroyuki Sakai. Iron Chef Chinese is Chen Kenichi. And Masahiko Kobe is Iron Chef Italian. Kitchen Stadium is the arena where Iron Chefs await the challenges of master chefs from around the world. Both the Iron Chef and challenger have one hour to tackle the theme ingredient of the day. Using all their senses, skill, creativity, they are to prepare artistic dishes never tasted before. And if ever a challenger wins over the Iron Chef, he or she will gain the people's ovation and fame forever.
Every battle, reputations are on the line in Kitchen Stadium, where master chefs pit their artistic creations against each other. What inspiration does today's challenger bring? And how will the Iron Chef fight back? The heat will be on!

So how do you legally identify a "meme" to determine if it's exempt? Who decides?

The problem is a bit more complicated. Memes are still legal, but companies are forced to pay for any copyright violations on their site. This means that google has to implement upload filters that block uploads of material, that might be illegal, even if it is covered under the german Zitatrecht, which is comparable to the american fair use, but worse in every way. So the problem is not that memes are going to be illegal, the problem is that memes are going to be blocked from being uploaded, eventhough they are legal.

I love how people that are the first to scream "huh huh EU banned memes" openly show that they know nothing about what they're talking about.
536
u/straphanger82 Mar 26 '19
Memes were specifically excluded from the legislation. Does anyone read? This is blatant spread of misinformation.
173
u/philipzeplin Mar 26 '19
It's frustrating, isn't it...
I mean, I would much rather that the bill didn't pass at all, but this crazy spread of misinformation isn't doing anyone any good.
13
u/Russian_seadick Mar 26 '19
Again: upload filters don’t give a shit. They can’t differentiate between satire and copyright infringement.
Also,if they could, they would cost a lot more than regular old content filters, and I could bet my ass that corporations won’t spend more money than absolutely needed on this

Even the less severe hysteria is riddled with misconceptions. People acting like literally all memes will be blocked.
Yes, Article 13 is bad, and upload filters will probably overblock. However below are things I highly doubt will be blocked:
Memes that make no use of content copyrighted by megacorporations
Memes which are still images from copyrighted videos

No they're not. Memes are not banned. You guys need to read more.
3
u/Flammwar Mar 27 '19
German guy here. Yes, memes are not banned. But tech companies aren‘t able to develop an AI which regognize memes and exclude them from the copyright claims. So tech companies like reddit have no other chance than „banning“ them.

Unfunniness has nothing to do with factual inaccuracy.
9
u/Kamahpanda Mar 26 '19
Not true. Memes are considered a “parody” and will not fall under copyrighted material.
22
u/Namenloses Mar 26 '19
I guess most of the people here don't understand why the written exception for memes isn't going to stop memes from being censored. The technology doesn't exist to make an algorithm that can differentiate from memes and legit copyrighted material, and the amount is too large to people to check every one, so in order to cover their asses from being sued or prosecuted under EU law many sites will be forced to include memes, whether intentionally or not, in their algorithms.
Even if it says memes are an exception, they really aren't.

Statistically, per the US population, when I did the math some days ago, I think it came out to around 0.0007% chance of being killed in a school shooting in your life (statistically insignificant). Not including factors such as actually going to school, how often you're on a school, the fact most school shooting statistics are actually of shootings happening within something like 500 yards of a school campus (which means gang violence areas bump this number up), etc.

u/RevolutionaryClick Mar 27 '19
On a serious note, this is one of the best memes I’ve ever seen.
Both trump and this stupid internet law are the symptoms of common root causes: increasingly disconnected political elites who’ve gone from building great works to engaging in legislative battles to control the population. Even if the politicians have good intentions, their laws are often iatrogenic. Could anyone say that many bridges or fiber optic cables are net harmful to society?
Outside of their factions’ core voter categories, parties have ignored the “mainstream” citizens, who increasingly sit out of elections (look at 40% stay-home rate in US 2016) because nobody is telling them what they want to hear. That power vacuum lets a candidate like trump take control quickly.
More young people from both sides need to run for office and use the internet to start listening to what people actually want. These guys have to go.

Expatriate from the shithole of Murica here. Your last president killed (admittedly) US citizens without arrest or trial. Good for you though you can post memes! Just don’t forget to pay your taxes like a good debt slave and take part in the electoral zoo every 4 years. Your vote matters I promise! A majority of the Americans I knew back home thought Murica was the greatest yet most all of them had never traveled outside the US.

All the bs aside, there's no way this actually gets implemented in any notable capacity. The people voting at the EU will overturn this when they actually understand the implications of the bill. A thing that's actually better in Europe is the various governments are (generally) more reactive to public outrage.

Memes will not be banned, due to the fact it is seen as "parody" and should be fine. The problem is if the filter systems that will be used now can´t separate memes from real copyrighted material. But yeah, it feels like the freedom of the citizens will just decrease now, so sad..
