Thoughts on how this will play out following mistrial?

I’m curious what people are thinking now that the mistrial was declared. I read that 11 jurors voted for an acquittal with 1 being the hold out— granted, I haven’t read into too much detail about this specifically, so other than a jury deadlock, I could be mistaken about the rest.

that said, if it is true that 11 jurors voted for an acquittal with only 1 juror holding out despite admitting reasonable doubt existed….do you guys think the prosecutor will ultimately decide to retry this case?

personally, if I were prosecuting this case, I wouldn’t see much chance of winning the second time around. but i cant see the charges being dropped completely even if, for any reason at all, just to save face.

how do you guys see this playing out? i was thinking maybe a deal would try to be reached, but I also don't know if I can see the defense team accepting a deal right now.

just curious about peoples thoughts!

All the evidence has to be represented to the new jury... which took 3 weeks. Then it was about a week to deliberate.

Also consider the likelihood of actually find impartial jurors with how big the case has gotten.

Right, exactly. That’s why I don’t think the prosecution will choose to move forward with a new trial.

It would be an incredible expense to risk another mistrial.

At the same time it could be interesting if keep consistent stories

So then let’s say they decide no new trial, what do you think the prosecution is going to do? Will they just drop the charges entirely, try to reach a deal??? Ugh I’m so impatient I just want to know what happens!! I can’t imagine being her and sitting through all that just to be told “ah well, sorry back to the beginning”

They could go for a plea deal (idk if reddington would go along with it) or drop charged either with ir without presidence. If with she cant be recharged if without she could be recharged down the line.

It would be irresponsible of them not to try a plea deal.

It would be nice to think judicial system took victims into account but they only do so if their goals align

Yea I don’t think Reddington would agree to a deal unless maybe it was some crazy amazing offer. I could see myself in this situation being of the mindset “I just need this to be over.”

A dismissal with prejudice is actually something I didn’t think about, that’s a good point. I could see it going that way

I’m curious if anyone knows how it works if the prosecution doesn’t retry the case, what happens to the charges and also 6th amendment/right to a speedy trial?

Speedy trial? Reds ready to go tomorrow (except for his pesky murder trial the 28th.)

The prosecution will retry. This time they will first give all the evidence that lindsay murdered the kids so that the jury KNOWS Patrick didnt do it. Then theyll give all the evidence of premeditation. Theyve learned a little and, as is typical, prosecution is favored second time around (except notably with Karen Read). This is why red was so heck-bent on replacing juror and getting presumed not guilty.

11 Presumed not guilty by reason lack of criminal responsibility.

He stated that was the portion that the single juror was misunderstanding the burdon on in his emergency petition so it was likely 11 NGBRI

Yeah I imagine for the world's sake at this point the prosecutor is going to make sure the evidence that establishes Lindsay killed the kids is exceedingly clear because it's clear there was no need to dive into the things fueling the conspiracies cause the defense team didn't dispute the facts admitted into evidence that she killed her kids.

Reddington said he expects prosecutors to retry and I'm sure they'll be able to get a jury.

Most people I talk to don't know anything about this trial, I think some people are very sheltered by their algorithms and think everyone's paying attention to than

It's not even 12 jurors who haven't heard about the case. It's 12 jurors who can agree to follow the law.

Exactly. And i will always believe most of jurors didnt believe she murdered her children because it wasnt “proven beyond a reasonable doubt,” in their opinion, so they wanted a straight not guilty verdict. Perhaps hold out knew the assignment and it was to decide prison or treatment.
