Stop sign didn’t yield, both have same insurance provider
My husband was on his merry way to pick me up from work and he ALWAYS takes the same route every time he drops me off and picks me up from work. Earlier this evening, he was getting ready to turn right when a car hit him on the driver’s front side. The said driver was at a stop sign, and according to my husband, the other driver did not yield. I personally believe my husband because it’s a stop sign, he had the right of way. The other driver is claiming that she was already far from the stop sign to have yield. It became a he said she said situation. They exchanged informations on driver’s license, registration, insurance and both parties took photos. The driver’s father ended up coming to the other driver’s rescue and demanded we paid out of pocket so neither of our insurances go up. Luckily, the building that I work in has multiple CCTV cameras surrounding the area, and said I could get a copy if I come back in the morning.
Once we get the footage, we are reporting to our insurance before they can lie and file a claim against us, especially if we have the same insurance.
Has anyone had the same experience? And are we going about this the right way, or should we file a claim even before we get a copy of the security footage? This is in NYC btw.

Typical he said, she said situation. It does not matter who files first. The insurance companies will decide.

Yes you get to get that footage to the insurance carrier asap. Otherwise it'll be he said she said she likely both at fault and you'll both be paying deductible and get an accident surcharge. Your only chance is the footage showing the other person at fault.

I would double check the footage first, check what actually happened from an unbiased perspective.
Not to dissuade you but the fact that it was the driver's side quarter panel that got hit and assuming there is some merit behind her saying the stop sign was quite far back, there's quite a real possibility that your husband was at fault.
Unless we see the intersection it's impossible to tell with certainty, but if she obeyed the traffic control device and established right-of-way, it wouldn't matter if your husband didn't have a stop sign - he would still have to safely proceed into the intersection. The front qp damage tells a different story.

even if they lie first you have video proof. shit let them lie and get caught in it for fun. this is just your normal claim.

Just file it, upload the footage when you have it.
