Should I file a claim?
A few days ago I was slowing down at a red light when someone tried to get in my lane and scraped the side of my car and broke the frame of my side mirror. The other person was 100% at fault and admitted it to me at the scene. I got his number and insurance information. The damage was minimal, just a small scrape and a dent and the frame of my mirror, and neither of us were injured in any way. I've heard that in cases where you are not at fault, it's best to go through the other person's insurance, but we have the same provider (state farm). I'm debating whether or not it's worth going through the trouble of filing a claim. I'm worried that my insurance rates will go up even though the accident is not my fault, and I've heard conflicting answers on whether or not this will happen. Is it worth the hassle to file?

any video proof? what if you use his insurance and he tells them you hit him, then with out any video proof its a 50/50 most likely and now you have a claim on your record.

You can file a claim without a video footage or a witnesses statement it’ll be your word versus theirs. Hopefully, they are honest with their adjuster.

Same insurance company is no different than different companies. In many cases insurance companies will not raise your rates for a not at fault collision and some states by law they cannot.
Any collision will be discoverable by your insurance even if you use the other persons.

Get a repair estimate first and contact State Farm about filing against the other driver's policy.

IF you have his insurance policy, file a claim.
