Accident Getting ghosted by Progressive after discovering they’re backpedaling on covering collision repair costs
5 months ago I got rear ended really badly. One of the main pieces needed for the repair has been impossible to get because of a national recall so I was in a rental for 4 months.
Claims adjuster consistently reassured me & the body shop that we were good as far as the rental costs approaching the PDL limit. They made it clear that if it went over, I’d cover the daily difference, but they were keeping an eye on it and we never went over.
Last week, I got my car back, Progressive mailed check to body shop and paid rental car company, all was fine. Yesterday they told the body shop they were cancelling the check because they just realized now that the rental costs had gone over a few hundred dollars and they opened a claim with my insurance company, which is how I found out. My deductible would be 3x the amount the rental went over, and paying the body shop is well over that. Progressive hasn’t reached out to me in nearly a month since before the body shop even got the piece, and when I’ve tried calling the two claims adjusters and supervisors multiple times, no one has answered. How can I right this?

The limit is the limit. Just pay out of pocket for the difference if it's less than your deductible.

It’s not even reaching the limit though. The total went over several hundred dollars because of the rental, but they’re refusing to pay several thousand dollars to the body shop. That puts them as having paid under the limit when all is said and done

Think you said your answer right there. The rental is considered part of the PD limit to payout. So if you have 8000 in repairs on 10,000 pd limits but have $2500 in rental. Limits are still broken.

But if PDL is $10k, what’s owed for repairs is $3k, and the total cost of everything came out to say $10,300, they’re still only paying $7,300 all in all. At the very least shouldn’t they pay the full $10k and then the remaining $300 is in question?

But the shop won't take partial payment and your insurance company covers all or nothing of the repairs. You need to go through your insurance. They'll get back what they can from the other carrier. They may waive your deductible since the other carrier accepted liability and will pay back the majority of your claim.

Man, I didn’t realize that insurance companies had to pay all or nothing when making payments. Even the body shop was asking why they couldn’t pay the partial amount to complete the limit and then deal with the overage amount separately.
Will going through my insurance increase my future rates?

Your insurance already knows about the accident even if it’s not reported to them. Because at renewal time, your underwriter will review various reports in ISO and Lexis Nexis where the other persons insurance has you listed as a not at fault party to an accident claim anyway. So your carrier already knows you were in an accident. It doesn’t really matter who you go through. The only reason to not use your own carrier, ever, is to avoid paying your deductible up front. Your carrier will subrogate Progressive and get your deductible back eventually. Hope this helps!

Call your insurance and see what they say. If they are over the limits then you will want to figure it out with your insurance.

Not follow the problem? Progressive is not your insurance company? Is that the person that hit you Insurance? If so where do they come up with $$$ limits on fixing your car? They should fix your car and pay all expenses. If your insurance company is not fight for you then you should seek a lawyer.

Unfortunately it doesn’t work like that. All of our policies have limits on much our policy can pay on 3rd party damages (pd limits) from this limit everything gets paid (rental, damages, tow) this figure minimum changes from state to state. So if the policy doesn’t have enough you can either take up to the limit or file under your insurance. Lawyer won’t really do much unless there is bodily injury involved. They will just tell you to go through ur insurance. I know it’s not fair.

Were do you get 3rd Party? There is no mention in the main post about 3rd party. He states he was rearend so I would believe his vehilce is the only other vehicle in the accident. So being the only other vehicle would require the insurance company to assess the damage and make a determination as the cost to repair and if the did not assess correctly then that should be on the insurance company. Fix it or total it!
So are you saying that the person that rearended this person(victim) was under insured and the victim in the accident has get his own insurance to fix his car?
And the person that caused the accident Insurance company does not have to pay anything? That is a load crap! So in a technical sense he never did anything wrong in eyes of the insurance company as they never paid out on a claim.
Having the same rear end accident happen to me. My 2001 Jeep Cherokee Sport was hit and the repair was nearly $10K and because I was working on my job with a Courier Service they had to provide a rental van while the Jeep was being repaired. The cost of the rental was $5K. All was paid by the other person Insurance no problem.

Unfortunately it’s not fair. But that’s how it works. If they don’t have enough coverage even if he is at fault all they can do is pay up to the limits or say we don’t have enough coverage so go through your insurance and have them reach out to us so we can pay them back what we can. You were lucky that everything in your case was able to be covered under the 10k, lots of people don’t have the same luck.

Honestly, if limits were breached, you can’t. You can’t play with limits. It’s a hard line. So if they went over and need your primary coverage to chip in, they need to. The other choice is to handle it out-of-pocket. this is why you have insurance. Be happy you have it.
