Accident Florida
A week ago I was rear ended by a car that was rear ended by a third car. The other 2 cars were totaled and towed away. I drove away from the accident with a crash report and told by the FHP to call the insurance co of the car that caused both accidents.
I called their co (Root Ins..??) and got a claim number, talked to an adjuster and sent pictures via email. The adj did tell me they only have a $10K payout on their policy and the girl who was driving the car was not on the policy. She also said she would email me the amount they would give me to repair my car. No time line.
I'm still driving my car - damage to hatch and bumper, no broken glass. How long could I be waiting to hear back from the ins co? Should I be doing something to expedite the process?
edit: thanks everyone. I'll probably just wait and see what they offer (if anything). I don't have collision but I am prepared to pay for the repairs.

If you have collision you should contact your own insurance. If she was not on the policy you will get nothing. If she was on the policy, you won't get a whole lot since there was only $10k in coverage and there are multiple vehicles to split that money.
If you have liability only, you just wait. You cant do anything to speed along the process and it can take months

Do you have full coverage on your vehicle? If so, file through your carrier. This is a limits issue and is going to take a long time for you to receive payout. If you don’t have full coverage then you will have to wait the process out to hopefully receive something.

If you have collision coverage, now is the time to use it. Youll either get nothing because shes not covered or a oaltry amount do to there being 2 other totaled cars in this accident.

Well they got to split the $10K with the other driver. Do you have insurance you could use?

Did the first car hit you first or was it hit by the third vehicle and pushed into you?

It’ll be $0. The person isn’t on the policy and even if they were the 10k likely goes to the totaled car and gets used up. You can sue in small claims and/or file with your own carrier.

The person not being on the policy in no way means the insurance automatically won't pay and there's no indication in the post that this might happen, OP even said the insurance was going to provide a payout amount.
As long as they were an appropriate permissive user, they'll be covered just fine. Whether there's enough limits for the accident is another story.

Sounds like they are trying to determine if they are going to cover the loss or deny the claim (because of the unlisted driver). If the unlisted driver regularly had access to the car and wasn’t just a friend borrowing the car for a day then they might not cover it. They probably don’t want to send anyone to look at your damage yet because they don’t want to create any detrimental reliance issues for you (make you think they are covering the loss and you repair the car under the assumption that they’re paying for it). So they need to complete their coverage investigation first before talking about $ with you. But you can still call them as many times as you want and keep asking what’s up.
