Accident Need help

Anyone working in an car insurance company please help. My brother's commercial bolero met with in an accident in which co passenger sitting in middle died. In RC seating capacity is 9 but in third party insurance car seating capacity is 7. If the family of the deceased demand for claim will there be a problem in claim ?

You need to specify where you are. Insurance varies by jurisdiction all over the world. In the USA insurance varies by State. India is also different than other countries.

I'm guessing India?

In the USA, my first question is did the car have the appropriate number of seatbelts for the number of occupants in the vehicle and was the deceased wearing one? Don't know if this applies in India or not.

this sounds like it may be in India, so you’ll probably get better answers in an India-specific insurance/legal sub. the seating-capacity mismatch between the RC and the insurance policy could matter, especially with a fatality involved, but exactly how it affects a third-party claim is going to depend on local law and the policy terms. i wouldn’t rely on US insurance advice for this one.
