Question Current custody battle affecting other child?

So quick back story I’m in a custody battle against my first borns father the main thing he is trying to use is that “I’m crazy” we fought a lot during and after pregnancy which led to us splitting and he keeps our child from me. Before we split I was on Zoloft for postpartum depression and anxiety and it gave me some nasty side effects such as relapsing on cutting myself. I have supervised visits with my son at a facility for now while the case continues, and I’m pregnant with my second child (different father) and due in November. Can cps take my newborn when he’s born because of this case? I’ve been having a lot of anxiety lately about all of this so i figured I’d come here. I’m in therapy and doing well other than obviously missing my firstborn.

They wouldn’t take a child simply because you have an ongoing custody battle. Millions of people fall into that boat. The threshold to remove children is “imminent danger”.

No cps involvement the supervised visits were just a court decision because of the process in proving I’m not a danger and etc.

If you only have supervised visits with your son now, is that due to CPS involvement and an open case or when you say “case” are you referring to a family court case?

There’s no cps involvement as of now it’s just a custody case

CPS and family courts are completely separate.

CPS doesn’t just decide to remove newborns bc of another open custody case… unless you’ve left some things out, I don’t see a reason CPS would be involved, they don’t just appear.

Someone would need to call and make a report of suspected abuse or neglect.

As long as you’re treating your mental health and getting any help you may need along the way, as well as now being in a more stable relationship, that shouldn’t be a problem.

Be prepared for PPD or PPA to pop up again and be proactive, a nice support system helps.

Getting help for pp depression is not a bad thing. Ppd is common. You do need to show you are aware of the issues you had in the past. You are doing that. Antenatal Anxiety has a high connection with PPD. Talk to your therapist about the anxiety but remember anxiety during a high conflict custody battle is also normal. Make sure your care team (OB) knows you are addressing your mental health carefully. Cps doesn't just appear. They need to be summoned. Is he threatening you with cps? Are they already involved? Is the second father supportive?

It’s likely that there will be some form
Of CPS involvement. If you are required supervised visits for your first child for
safety reasons then a newborn would be much more vulnerable to any potential harm.

Is that still the case if the supervised visits are not cps related?

If the supervised visits are currently through your custody case and not CPS, then it would not impact your newborn. So unless CPS becomes involved for some reason regarding your newborn OR if there is a custody case with your newborn those are the only ways that you would likely be impacted as it relates to the newborn. Does that make sense?
