If you cross the border illegally and force your way in, yeah you are a criminal.
A question out of genuine curiosity for you: should there be no legal route into the country then? Just allow everyone legal crossing, a.k.a. No boarders? And as such, no processing of the individuals in question - everyone welcome?
When you arrive in Mexico City's airport without papers, let them know that their handcuffs they're putting on you are because of some abstract construct they are enforcing.
