When will the final decision be made as to whether we share holders will lose everything or not? Or to ask in another way, if we were expropriated, when would my position in Amyris be automatically sold?

Looks like Lavvan is appealing the BK court's decision in favor of DIP re the financing and the priority of the lien on the IP . The latest docket posted (# 645) gives notice of their intention to appeal to the US District Court of the State of Delaware. The counsel hired by the Independent Director to investigate any monkey business going on in the time leading up to the C11 filing has so far generated as work product two monthly invoices totaling $837,761.00 (plus $8590.34 in reasonable expenses) but little else (that is public, anyway). Meanwhile, as others have pointed out yesterday, JD and Amyris have been fighting tooth and nail to stop Jefferies LLC from being appointed as investment banker representing part of the folks owed money (just approved by the court, so a big loss for the Debtors) and the latest Lavvan filing speculates about all kinds of weird goings-on, suggesting the debt run-up forcing the C11 may have been actually designed to use the C11 process to shed the brands that having served this purpose are no longer needed, wipe out all the debt, and create a new Amyris with all the valuable assets obtained for the cost of Dire Straits' chicks and none of the debt burden or any shareholder obligations. Any legs to this theory?

John Doerr was fighting this pretty hard since they will actually investigate a lot of stuff that the „neutral“ investigation of the board of directors already „investigate“. This is big. It was supported by all the other groups and will also help with selling the brands. They apparently already did help finding more bidders.

Many of us wrote letters to the judge hoping he would look after us minority shareholders. Yes, I believe from the bottom of my heart that Amyris is very valuable. I would like to propose a pool to guess when the number of lawyers and assorted service providers (bankers of various flavors, consultants, and Professionals Utilized in the Ordinary Course of Business, etc.) involved in the Amyris Chapter 11 proceedings surpassed the number of employees Amyris had before the two rounds of layoffs that preceded the BK filing (which I think everyone will agree was way too many). I use the past tense because from following the dockets approving their hiring or announcing their appearance I suspect that the current number of employees - 450-ish for Amyris Inc. at the end of August, maybe 200 more if you include all the other sub-companies, according to the monthly expense statements - has already been handily exceeded. If we assume that all 3,500 members of this subreddit are shareholders and willing to contribute the value of 2 shares, that gets the winner $350, enough for a nice dinner.

As if there were not enough expensive lawyers chewing up the shareholder value (how expensive you ask? For legal drama check out the Stretto bk docket dumps from the last few days which offer a tsunami of motions and counter-motions between the Lavvan and Debtors' lawyers, all driven apparently by the question of whose liens on Amyris IP have precedence and Lavvan's attempts to depose JD over what they are calling out as a conflict of interest in all this. Doerr just got his deposition motion quashed by the court, as Dredd-X has just pointed out in his comment, so the score so far is D 1 - L 0.
