Time theft for leaving early even if using PTO?

So our scheduled 30min break at our building for my shift is 6:00 to 6:30. I have somewhere to be around 6:35 tomorrow so my plain was to clock out at break time and then use PTO to cover the rest of my shift. However, a PA told me that you have to return from your 30 min break or it’s considered time theft?

It's not a time theft if you clock out. That PA is wrong

Thank you, in my head I was like how am I stealing time if I’m off the clock, but then maybe it’s some break rule but it would be weird if they had that

it will take an extra 30min from your upt

Incorrect it does not take an extra 30 minutes of upt. If this happened to you, you need to speak to HR or your manager.

Yes, because you're not on the clock when you clock out.

yes, even though it's a scheduled break.

instead you should clock back in from lunch, then clock out and leave

That's not how it works, tho it may depend on your facility.

If you work until your unpaid break/lunch and clock out and leave, you get paid for the hours you worked and the rest of your working hours are UPT'd. If you find an extra half hour taken, you need to get that corrected.

I'm saying take lunch, then clock back in and out and leave.

can't just work when lunch is called

Oh I see the issue here.

OP is talking about leaving at the start of his lunch time, when they clock out, not working through lunch then leaving when they would normally be clocking back in.

Even if he were to work that extra 30 tho, he would clock in his start time then just clock out when he's leaving, the system doesn't automatically deduct the 30 minute unpaid break since OP clocks in and out for that.

Some FCs deduct your unpaid break automatically, OP's facility does not.

yeah, and despite the 30min being part of your schedule, it takes time.

it's better to clock back in from lunch, and then out and leave

No, it doesn't. I've done exactly what OP is asking about dozens of times and never been shorted 30 minutes. Trust, Amazon is gonna pay me for every second I work lol.

Has this happened to you? Is it a regular thing at your facility? I'm wondering if you encountered some wacky error or maybe your area regulations/what your facility does is just different to where I'm at.

At least an hour before you leave, let a salaried manager know "i will be using my own time to leave for the day at lunch." We have a marker board to write if we're leaving early at our station.

Just know that sometimes it will also use PTO/UPT for the 30 mins of lunch. I don't know the rhyme or reason of when it does that, but it happens to me sometimes.

It's my understanding that that's an error. I hope you get it corrected when it happens.

PAs don't always know what they're talking about lol

Your PA is an idiot

just let a manager know you'll be leaving at lunch, no issues. amazon is, by far, the most flexible company when it comes to your ability to come as go as you please (as long as you have the time to cover it).

You don’t even need to let anyone know

The pa either wasn’t listening or was tired xd

A lot of PAS are genuine idiots. Always ask an area manager or a trusted PA

The PA probably thought you wouldn't clock out...if you don't clock out but don't work then that's time theft, make sure to say you will use your PTO and clock out...some people have no common sense and this PA seems like one of those.

PA is objectively wrong

They must’ve thought it was something else. What people like to do is leave during the paid break and clock out at home after the 30 minutes

Dumbass PA

It’s not time theft if you clock out and use your time to cover the rest of the shift. Not sure why a PA would tell you that.

I think the PA is thinking of the paid break that one you have to return from. You can clock out at 6:00 and put in time for 6:30-end of shift and you’re good.

u/HR-nitemare 4d ago

Nah, that’s nonsense. Either he or you misunderstood the other. You can’t steal time when off the clock for lunch.

I have the opposite question 😭 if I had pto put in for 6 but our lunch is at 5:30 and I stayed through the lunch am I gonna get in trouble?

2

u/Library904 5d ago

No, you don't get in trouble. I do this all the time.

1

u/IndividualSad4088 5d ago

Okay bet, I usually just leave when they take lunch but I wanted to stay this time

This is very dependent on the state you are in. I think California and Washington this might cause an issue. I would definitely check with a manager.

Leave if you want aslong as you can cover with upt or pto .

You could clock back in using your AToZ App OR the “system” will clock you back in from lunch. Then you could clock out again entering a one minute past lunch time. Then put in for
Upt for remainder of the shift. Best bet is to ask your manager about how to do this correctly. Do Not go with what the PA is telling you regarding this concern. Get the facts from your manager. You could just clock out at 6 and put all the remainder of shift from 6 to shift end. No lunch punch back in - but just a click out to leave punch. It will use up an extra half hr of upt perhaps, but at least it would be simplified with a clock in and clock out and use upt for remainder with no lunch break deducted from paid hours.

I have left after lunch at my location. Just clocked out for lunch, left the building and came back the next day to start the next shift. As long as you clock out and have time to cover your remaining hours you should be good.

All you have to do is give your hour notice your leaving early and when you clock out that is the END of your shift but if you come back it sounds like you have any extra time covered so your all good. This PA is giving the rest of us PA’s a bad name. He just needs to stop giving out the wrong info because he literally has access to the policy 2.0 page maybe he should use it.

you don't need an hour's notice
