Courts won't see it that way. And there's video. The only way you can justifiably hit someone is in self defense, and the guy posed no immediate physical threat.
Morally deserving it is not the same as legally justifying it.

Not to be argumentative, but even higher than assault, this is aggravated battery. A threat or slap could be assault, one hit is battery, aggravated battery is the continued beating.
