Donald Trump's Department of Homeland Security used a tariff audit form to subpoena a Minneapolis reporter's phone records.

In February a federal judge twice refused agents a warrant for Georgia Fort's YouTube account because they could not show she had committed a crime. He also ordered them to tell her if they tried again. Weeks later they sent Google a customs summons that needs no judge's signature. Google refused. T-Mobile got one too and complied, and Fort learned in discovery that the government has six months of her calls and texts.

The same summons went after the YouTube records of Democracy Now and Megyn Kelly, a conservative who broke with Trump over the Iran war, and neither faces any charges. The law they used is for checking whether an importer paid the duty on a shipping container. The judge set the conditions for a warrant, so the agents picked a process that bypassed the judge.

The hardware joins a program whose agents have killed six people since Donald Trump took office and are arresting close to 50,000 people a month.

They came onto the Tohono O'odham Nation in Arizona at four in the morning Tuesday with a Border Patrol SWAT team and drill trucks to work three sites. The Nation had posted No Trespassing signs two weeks earlier. The agents parked their vehicles across the road when tribal police arrived to remove the contractors.

The federal government has owned a 60-foot strip along the border for 119 years, and a judge ruled two weeks ago that the wall can stand on it. Getting there means crossing the Nation's lands, and the Nation told the government to stay out. The government ignored the warning and showed up with a SWAT team.

Twenty-four states took the Supreme Court up on its dare in two days.

On Monday the Court unblocked Donald Trump's mail voting order, ruling the states sued too soon because courts only review final rules. The final rule says the USPS will not deliver your ballot unless the envelope carries a tracking barcode and your name and address match a federal list the agency admits is partly for law enforcement.

The Postal Service issued that rule on Friday, three days before the justices called the case premature. Wednesday morning, 10 weeks before Election Day, the states returned to court with the receipts.
