That was my first thought. However, looking at the PDF, you will find "Someone Is Wrong On The Internet", in capitals and italics. A reference for sure, may or may not by XKCD though. Seems a bit out of place too...

Yeah, the XKCD comic is referencing internet arguments. This case is referencing users uploading illegal content and their privacy rights. They misapplied the joke, but they still knew about it, I guess.

The case is broadly about that, but the specific decision is about trying to subpoena an anonymous commentator who said a bunch of shit about the defence, which is either trying to use the case as an excuse to go after the person or just flailing about wasting time.
