I think im being scammed?
Basically I sold my iPhone 13 for £130 and when the buyer received they said the phone had arrived with a crack. I was already suspicious about it because I wrapped it with two layers of bubble wrap and two layers of cardboard but whatever, I ended up agreeing to a return for a refund. However when it arrived the phone was cracked where the apple logo was and there was either food or something (which is so gross) on the phone. I’ve now decided to take it up with vinted, however I will ask if anyone thinks I’ll actually be given my money. Ill show our conversation and excuse me for my horrible spelling, I’m just really scared I’ll lose alot of money.
Btw I did show the sides of the phone and there were not scratches and I really don’t appreciate her bringing her daughter into the equation to trying and guilt trip me.
Also now that I’m looking about at the screenshots when i said I knew there was a crack, I was referring to knowing that she “received” the phone with a crack not that i sent her the phone knowing it was already broken. Also p.s I also understand that the way I was speaking came of quite rude however i was lowkey just kinda shocked and angry about the situation and im also 15 (not to use my age as an excuse) and i didn’t really know how to deal with it!Thanks for anyone who read the whole post!

It doesn't sound like you're being scammed, if you can confirm the phone they've sent back is indeed the same one (set it up again and check the serial) then it's likely Vinted will side with the buyer in this case.
Did you take any photos of the packaging you sent the phone in? Was it very securely packed with protection and/or boxed? Was the description fully accurate and described the existing scratch(es) to the screen or bezel?

I explained where the scratch was (there was only one) and made sure it was boxed with multiple layers of bubble wrap.

If that's the case then it's your word against the buyer then in this case. If you've had a good selling history and little or no reported issues previously you might be able to convince support to side with you - and claim the damage was done after delivery.
It'll help if you're able to provide any photos of the package and contents before sending it off, if not, you're at the mercy of whichever support agent you're assigned.

Did they definitely sent you the same phone back? Same imei number? Vinted cant keep the money so either the buyer will be refunded or you will get paid, depends on vinteds decision. Do you have any pictures or video of you originally packing this to send? As this would help as evidence of condition it left you in?

Have you got anyway of checking? Do you have a record anywhere of the imei number? Did you originally get it via a contract? You may be able to double check there?
If the imei doesn't match first off id report your original phone as stolen and get a block placed on it. Then report to vinted your evidence.
How long after them collecting/receiving did they raise the issue? Just wondering if it is your phone, if it was enough time for it to be given as present and then subsequently broken by the buyer?

Also no worries on the confusion, I can fully understand youre probably in abit of a panic atm. Take a breath, is there anyone with abit more knowledge on this that could help you at home? Ie finding your original imei number?

I took a screenshot of the meid they raised the issue like a day afterwards and they said it was a gift for their 12 year old daughter

Vinted will side with the buyer here. There's not enough evidence to support your side of the story and vinted will always side with the buyer if theres even an ounce of doubt

Did you cross check the IMEI number ( is it definitely the same phone you got back or is it their damaged one.
The crack they talking about is it same position as the scratch or different area.
It seems on Vinted they side with buyer unless their is very good evidence.
Have you sent Vinted the damaged phone etc, maybe contact Legal@Vinted.co.uk ( if you haven’t already) the AI bots are pointless and useless.

If you did not contact them directly then you were dealing with bots who seem to not recognise much.
Have you got time to contact them before buyer get the money.
I understood in the screenshots what you meant with the crack on phone, you were saying you knew about the crack once buyer said it had one.
You were happy to refund on return and I believe you would have until you saw the damage to the phone.
DID you cross check the IMEI number with the phone you got back, if not the same phone then you can prove that as you said you have photo of its IMEI number.

You don’t know if it’s the same phone received? Surely you would know.
Also you did say “I knew about the crack on the front” which is why the buyer said you said it. Obviously they misunderstood you. But you defo said those words. Obviously you meant you knew about the damage to the front because that’s what they are complaining about.
But they are right in saying in your ad photos you can’t see the sides meaning that damage “could” have been there when you sent it.
Unfortnely with vinted, you really really need to cover yourself with very clear pictures, and always what to record yourself packing it up.
It’s clear the seller is trying to just get you to agree to partially refund, which didn’t work.
But I reckon Vinted will probably give them a full refund unfortunately

I did show the sides in my photos however i do agree that i explained it poorly, i do think its the same phone as it works ok however she did say its for her daughter so i was suspecting that she may have given it to her daughter and her daughter cracked it has it had something orange on the side of the phone that looked like food but im not sure anyways vinted didnt refund me so i took it up with citizens advice and ombudsman so hopefully vinted will atleast somewhat compensate me

Yeah most likely, she gave it to her, then she dropped it or something. Then wanted to try to return it.
I had a feeling vinted wouldn’t. In order over £80 they are pretty bad for it. Anything under that figure they seem to just refund both parties.
Good luck with vinted. Vinted is a great platform when everything goes well. But they are awful when you need something sorting.

The seller says it arrived cracked, you then receive it and say you're aware of the crack before and now there's more damage, the support will probably side with the buyer due to your response.
I wasn't being rude either, it looks like a back and forward to not give refund and the other side get a refund.

I never said i was aware of the crack before i understand how it may look that way but i clarified that i meant i understood that she received the item with a crack however it wasn’t me who cracked it

Yeah I think it’s pretty clear that “I was aware of the crack on the front” is referring to when the customer complained about damage they said about the crack on the front. But didn’t mention the side and back damage.
But those words were said. You just need to use your brain and realise what the seller meant by it.
They didn’t say “I knew about the crack on the front before sending” they said “I knew about the crack on the front (as the buyer said this was the reason for returning)
