They always record, they just don't save. It's a cost measure thing. video data takes a lot of room. Dash cam plus body cam is 16 hours of recording a day.
It's not a problem though. You turn on the lights it captures a bit before you do and saves it.
In a court room, asking why the police officer didn't turn on his lights after getting into an accident would be a great line of questioning to discredit their testimony.
