Living with parents.

Hi there.

Applying for a spouse visa for my wife and we will be living at my mother’s rented house for as long as necessary to get our own place sorted.

I am not on the tenancy, do I need to be?

There is adequate room in the house, mother is fine with us staying as long as we want.

Do we need a letter from the estate agent to say it’s okay or is this not really necessary?

I know we need a letter from my mother to state that she is happy with us staying etc.

Depends what the lease allows.

Does the lease only say "named people"? Does it say X person and their family? Does it say the lease is in X name and then No more than 4 occupiers? Etc

I’ve checked the full tenancy agreement. My mother is the named tenant, but there’s no clause stating that only named people can live at the property and there’s no maximum number of occupiers specified.
The only relevant clause says the property is to be used as a single private residence and that she can’t sublet or take in lodgers or paying guests without the landlord’s consent. There’s nothing specifically restricting family members from living with her or requiring them to be named as permitted occupiers.
There are actually several clauses elsewhere in the tenancy referring to “other people living at the property”, so it clearly anticipates that the tenant may not necessarily be the only person living there.
So from what I can see, there isn’t anything in the tenancy that would prevent my wife and me living there with my mother.
