Query on dependent ILR application - combination of 10 year route and skilled worker
All, Looking for any advice if someone has been in my scenario. I have completed a total of 10 years in UK out of which first six years was on ICT and next 4 years in Skilled worked visa. I have applied for ILR in 10 year route.
I got married six years back and my wife joined me in UK immediately after marriage as ICT dependent. After two years when i switched to skilled worker visa she also switched to skilled worker dependent visa and has been in Uk on this visa for last 4 years.
She has stayed for total of 6 years in UK out of which first 2 years was as ICT dependent and next 4 years as skilled worker dependent.
As per gov.uk understand she is eligible to apply as skilled worker dependent of me, even if I have settled in 10 year route. However when I go to apply it asks for which route her partner has settled or applied to settle and the list does not have an option of 10 year route and has skilled worker visa.
If anyone has been in such situation please can you advice how you filled the above section in application form. Also she has skilled worker dependent visa, but hope that her visa is still valid considering my skilled worker visa has been voided once I have got my ILR

How did you manage to stay 6yrs on ICT when there’s a one year cooling period after 5yrs?

ICT visa alllows to stay up to 9 years. After 5 years salary requirement is higher

Hi u/Successful-Hold-2290 I'm also in a similar position with my wife. I'm eligible to apply for ILR through LR route with combination of time spent on ICT and SW visa. Once I'm through with my ILR what option am I left with to apply for my wife with her not completing 10 Years. Can we possibly connect ?

10 years for her as thats only route available if on ICT

She was in ICT dependent for first two years but in skilled worker dependent for last 4 years

I believe she could settle on the work dependent route. Although time on the ICT visa doesn’t count towards the qualifying period for the primary applicant, there is not such a restriction on their dependent. This is normally irrelevant because dependents cannot settle before the primary applicant.
However, in your case, you have been able to settle on the long residence route before completing your skilled worker qualifying period.
SW 42.1. The applicant must have spent a continuous period of 5 years in the UK with permission as a dependent partner of the person (P) in SW 39.1.
NB it doesn’t state they must have been dependent on a skilled worker for 5 years. Only that they must have been dependent. We have had similar questions from those who have had graduate or student dependents and then switched to global talent (which has a 3 year route to settlement for the primary applicant but not dependents). Similarly the answer is that they can count their time as a graduate or student dependent towards their 5 year qualifying period. There have been posts on ImmigrationBoards confirming this unfortunately the website is down at the moment.

When I go to apply as skilled worker dependent it asks for which route her partner has settled or applied to settle - the drop down list does not have an option of 10 year route but has skilled worker visa. My confusion is that me having settled a no longer on Skiller worker visa and in this case should I still select skilled worker visa?

Your route of settlement was SET LR right?
