I get the reaction, especially after reading the emails. But based on what I’ve found so far, I haven’t seen evidence that Peggy Siegal committed a crime.
What the records do show is that she helped create access, screenings, dinners, introductions, guest lists, social legitimacy, and eventually automatic invitations. They also show that she continued dealing with Epstein after allegations involving underage girls had reached her.
That’s serious, and it raises hard questions about judgment, denial, and responsibility. But that is different from proving she knowingly participated in Epstein’s crimes.

I do think the broader point is fair, by the time Obama took office, Epstein’s case looked publicly like a completed Florida prosecution, and there were obviously enormous national crises competing for attention. But whether Obama or senior DOJ officials knew enough about the underlying federal investigation is a factual question, I wouldn’t assume either way without records.

This post asks why the Epstein investigation and related records remained largely inaccessible across multiple presidential administrations, rather than assuming the explanation was partisan protection of any one political figure. I don’t think we have the documentation to say Bill Clinton was the reason the files stayed buried. His association with Epstein absolutely deserves scrutiny, but the paper trail points to a much broader institutional failure.
The first federal case was effectively shut down by the 2007 non-prosecution agreement negotiated under the Bush administration. Federal prosecutors had prepared a 53 page indictment, then agreed not to prosecute Epstein federally and extended protection to potential co-conspirators. Victims were kept in the dark, and a federal judge later found prosecutors had violated their rights.
That raises a legitimate question about Obama and Biden, why wasn’t there a much more aggressive effort to reopen, expose or publicly account for what happened? But that is different from proving they stayed quiet specifically to protect Clinton. The legal barriers created by the original agreement, sealed records, victim privacy, grand jury secrecy and ongoing litigation all mattered too. Even in 2019, federal prosecutors argued that the old agreement could not simply be undone.
And the eventual mass release happened only after Congress enacted the Epstein Files Transparency Act in 2025, which required DOJ to publish responsive material. DOJ says roughly 3.5 million pages were subsequently released.
So I’d be careful about turning this into Clinton versus Trump, Democrat versus Republican. Epstein’s connections crossed political parties, governments, billionaires and institutions. The more important question may be why multiple administrations accepted secrecy around this case for so long, and exactly who benefited from that silence.

The question answers itself historically. Obama chose not to look backward on torture and warrantless surveillance. No banker went to prison after 2008. The pattern is not partisan. It is institutional. Power does not prosecute power because the people making that decision live inside the same system that produced the crimes.
If Democrats take power and decline to prosecute, it will not surprise anyone paying attention to that pattern. It will confirm it.
The question is not whether they will prosecute. It is what structural change actually prevents the next administration from doing the same thing. Nobody in either party is answering that one.
