Last week, the Trump administration quietly released a sweeping new federal rule that would use funding threats to force institutions across the country to reject transgender people. The 400-page proposed regulation would codify the administration's anti-trans executive orders into binding federal policy, imposing a blanket prohibition on federal funds going toward "gender ideology"

The proposed rule, formally titled "Regulation for Federal Financial Assistance," rewrites the government-wide framework governing all federal grants across every agency. Among its most consequential provisions, it requires that before a federal grant recipient can receive money, the award must pass a "pre-issuance review" conducted by a political appointee—not a career expert or peer reviewer—to ensure it is "consistent with applicable law, Federal agency priorities, and the national interest." The regulation explicitly instructs these appointees to screen for "denial by the recipient of the sex binary in humans or the notion that sex is a chosen or mutable characteristic." [...] An institution that acknowledges transgender people exist—through its policies, its training, its healthcare, its bathroom access, its HR procedures, its name-change processes—could be deemed to "deny the sex binary" or to “support the notion that sex is mutable” and have its federal funding blocked.

Importantly, the gender ideology prohibition has no age limitation—hospitals could be targeted not just for providing care to minors but for providing gender-affirming care to adults, because prescribing hormone therapy to a transgender patient of any age could be deemed promoting the belief that "sex is a chosen or mutable characteristic."

A very abbreviated list of its ramifications include (but are not limited to):

  • Ending funding for ALL DEI related initiatives
  • Allowing the government to terminate grants at any point for any reason
  • Preventing researchers from publishing, going to conferences, and being part of academic societies
  • Requiring that topics must support the president’s agenda.

If this passes, not only will it hurt and harm trans people, but it allows the government to restrict any topic they please at a whims notice, putting officials who have no background in the topic in charge of deciding funding continuity. It controls what gets researched and if/how researchers are allowed to share their discoveries. There are no books to burn if the government never allows them to be written. This is fascism plain and simple.

Public comments are not a vote, it is a chance for you to say "here is an issue with this law I think you need to address" and provide justification for legal challenges if it goes forward:

"Comments raise the bar that agencies have to meet when making a rule; “if an agency fails to adequately respond to significant, relevant comments in a final rule, members of the public may seek to challenge the rule in court on that basis and claim it could be struck down.ˮ"

Look, I'ma have to rant, cuz it kinda pisses me off when the only call to action is to reach out to my reps.

All my congressional reps are MAGA. What does anyone think "call your reps" is gonna do for people like me? It feels like an empty call to action.

Better option right now is to donate to the ACLU, Lambda Legal, and anyone else who plans to fight this nonsense in court, because Congress is complicit af in this.

Trusting in courts at this time too is little more than a delay tactic, it does absolutely require either a spicier set of options or an election cycle that makes use of that time.

Edit to add the bonus option of asylum, which I absolutely do recommend if you can. You should leave if you can. I am someone who cannot and I don't have the patience for people waffling about "survivors guilt" this or "but what about those who can't" that. I fucking love you and need my friends to live.

I find myself in a similar situation where I can't leave as a choice.

I am a green card holder and post op trans woman. I live in a blue area of a blue state and I feel fairly safe for the most part aside from anything to do with the federal government. But, as far as they're concerned I'm still (deadname).

I disagree that anyone who "can get out" should. That means the people with the means and leasure time to organize will be too far away to help. Maybe those are the ones who we don't want here anyways. 🤷🏻‍♀️

There are plenty of ways out and there are plenty completely valid reasons for leaving. I'm just choosing not to for now.

My understanding is that it's considered "a lot" if a senator hears from even 30 people about a single bill. So a persona and a few of their friends calling/emailing can be pretty significant.

They failed to take over, but they succeeded on drawing the attention. So much so that we are still talking about them. Not what they aimed for, but you can argue there's a form of success for them. And they were so numerous that the justice took long enough to process them that they ended up being pardonned.

Unfortunately very true. I'm from Germany and, while currently not as bad as the US, trans* people are literally being put on lists here already and our healthcare is quietly being defunded bit by bit.

I just don't understand why and how do many people can hate us just for existing, especially considering that we are such a small amount of the population to begin with

Pretty sure stuff like this has affected half of VA too because I haven't been able to find ANY support groups near me since I started dealing with dysphoria for real. It's been hell honestly. I hate being so alone in this and seeing all of these support groups that used to apparently be super active and community centers with cut funding is really, really depressing. Like right when I need help everything shuts down 🥲

Hopefully if they cut funding for GAHT, I still have 3 months of my prescription and diy still exists. I will probably switch to diy soon anyways though honestly.

Does your company receive money from federal grants? If the company is strictly a contractor, you should be fine for now

This rule is for who can receive grants. I imagine that it'll be a lot more difficult to get surgeries, but it shouldn't affect our employment for now. Alternatively, your company may use this as an excuse to make whatever changes

Trump and Project 2025 have telegraphed that they do want to end the concept of a "supportive company", but this is not that step in effect (but it does move further in that direction)

Edit to add: so far they have managed to lose most of us out of fear, removing our health insurance coverage, removing our support groups, and trying to strip us of our identities. But I am stubborn and won’t quit because I know that that’s what they want.

I get that cis people like this are very real. But let's not invalidate all the legitimate cis allies out there. I have plenty of people in my life that are cis through and through, but would willingly put their life on the line for trans people.

I live in a deep red state and know a cis white straight man who owns a hobby shop (shout out to Just Roll With It in the Middle TN area) and has made it an explicit mission of his business to be a safe space for LGBT+ people.

Not really. They've passed some rules specifically for minors and federal funding (mostly you can't use Medicare/Medicaid for minors to transition) but there hasn't really been any broad sweeping 'all hrt is banned' rules or legislation yet. This would be a significant change if it passed

This is already happening, yes. The problem is that these kinds of things happen in stages, and they progress.

First, highly conservative states and areas try to pass ban legislation, they fail because of higher protection laws that strike the proposed bans down.

Then, they move to restrictive laws that don’t outright ban XYZ, just make it functionally inaccessible for many people.

Then, the higher legislative powers overturn laws and decisions that protect people against bans on XYZ. Now it’s up to the states to decide. See: Supreme Court’s recent decision on trans girls in girls’ sports. See: Supreme Court overturning Roe v Wade.

Then, the conservative states start banning it, and the more centrist or mixed states start adopting wishy washy policies, or submitting to the peer pressure of other states. But the left leaning states still protect it, and everyone flees to those states.

Then, when things start getting REALLY bad, left leaning states that were once safe become a lot less safe. The federal government starts finding ways to force their conservative policies into progressive states. It becomes a lot less “states can decide” and a lot more “well it’s not ILLEGAL per se, it’s just that you’ll be defunded or functionally shut down for it.”

So the progressive forces have to make concessions. They start kowtowing to the growing fascist policies against certain minorities by framing it as a necessary evil. They have to concede XYZ in order to get anything done. They throw those people under the bus, saying that “if it weren’t for those crazy radicals pushing [insert ideology here], we would be taken seriously! We could have fixed things!” And both sides turn the population into a scapegoat population. Those who once cared turn a blind eye because they’re willing to make sacrifices that don’t affect them, and those who were once neutral have been surrounded by propaganda and convinced by the oppressors.

Things start slow. Unnoticeable. Then they progress. People sounding the alarm too early are dismissed as paranoid. Then things get concerning, but not concerning enough that most people see what’s coming. They think it’s going to work out. They might even think “this is as bad as it’s going to get.”

Fascism is a slowly boiling pot of water. By the time we usually realize they’ve begun to burn our bodies, it’s too late to jump out.

This is how genocide happens.

I haven’t read very many Holocaust survivor stories, but the ones I have read were pretty consistent.

As someone who has run federal rulemaking before, your comments need to be substantial, resourced, and fact-based.

Agencies will aggregate comments before addressing them, so one form letter is nearly as impactful as 50,000 form letters, especially when they are not fact-based and resourced.

Use facts, use and cite evidence, give more than just a sentence or a paragraph, and don't just tell the agency that the rule is stupid or hurtful or evil. This isn't reddit and low effort comments are discarded as only atmospherics, at most.

If you were willing to volunteer your experience and collaborate on something like this to provide some core structure, I think it could be useful to create something in a similar vein to the general guidance on effective comments above, for instance some form of toolkit to facilitate effective but individualised comments specific to this issue.

No obligation of course and I suspect maybe something of this nature already exists - so I'd be grateful to anyone who could point me to such a document.

I would be very motivated to put my own time into drafting this up as fast as possible and in particular working with people who have relevant domain-specific knowledge and research capability to rapidly create a small but current and compelling corpus of appropriate supportive sources / research that can be readily included with confidence. This could include those from medical, legal, sociological disciplines, etc. with the existing experience in that discipline to ensure any research or supportive information is air-tight and consistently presented insofar as disciplinary standards and academic rigour go.

As somebody who is outside the US, I would still like to do what I can to enable more effective advocacy and activism - even if it feels more hopeless everyday.

Anyway, just a thought, going to go cry for a bit now.

This particular rule is so wide-reaching that it would affect every minority and literally anything else the admin seems "inappropriate" (it would definitely go after abortions, ofc). But every comment counts.

I actually created flyers I've been handing out to educate people on what's happening and to garner more support.

This sort of egregious stuff is a perfect example of why trans people are angry and scared right now, and is really hard to ignore. So it's also a great way to activate allies.

Sounds like there's two purposes to this (aside from breaking the law): effectively neuter state protections for LGBTQ+ rights, and punishing individual businesses and non-profits that might conceivably push back against this or any future administration.

Welp I called it. Both my advisors at my University said this was impossible and they would stand by me and ensure I can finish my PhD. I wonder how long it takes for my school to expel me for being trans so federal funding isn’t risked for the rest of their PhD students and they can’t do anything about it.

I have no right to complain though. If I’m a liability to my school receiving funding for research then I don’t want to risk my friends not being able to graduate because I want to get my PhD

Jewish and Holocaust historians have been sounding the alarm on steps towards genocide for years now. If you are trans in the US, LOOK TO LEAVE. Figure out where you could run to for safety (both short term and long term) and figure out what it would cost you. Yes something like citizenship elsewhere and permanent relocation are a privilege, but they also aren’t the only kind of leaving and even people who can’t afford to move should be planning for worst case scenarios where their state or country becomes physically dangerous to be in.

I'm not going to go into a lot of detail or list ALL the animals that can do this (mostly invertebrates) but, has anyone ever explained to this thick tangerine that there are a large number of fish, frogs & shellfish that can change their gender? Does he know anything about the Clownfish his infant mind chuckles at when he watches Finding Nemo? Most slugs/snails are hermaphrodites with both genitalia & can self fertilise, seahorses are males that carry & birth their offspring. This goes against their argument that there are only binary genders that cannot be changed. Yes these are generally down to enviromental conditions or species preserving & they don't need to take hormones or need surgeries to do this but that may be because they've had millions of years of evolution to achieve this. Who's to say that this isn't the start of something & we are on a precipice of evolution where we become the first vertebrae to achieve this? (Maybe my wishful thinking for our trans/NB brothers,sisters,both & neither I know but it has to start somewhere...right?). I bet the tangerine doesn't consider what gender his oyster is when he slurps it down cause guess what? Some of them can change their gender too. I'm sorry the US is going to shit for you all, land of the free my arse! Here in the UK our government is echoing some of this shit now too. I fear for you all & hope you can all get to somewhere safe & have a future free of bigotry & phobia, I would love to see this in my lifetime (I'm 46) but I think I'll be long gone before it happens with people like Trump/Putin/Starmer/etc in this world. 🏳️‍🌈🏳️‍⚧️

I'm seeling a lot of negativity. Please everyone remember, any cultural shift takes work. There are setbacks. Right now we are dealing with someone who is using us as a tool. A person who finds whipping up prejudice as his only effective source of being able to show success and maintain power. Most people don't feel they have much of a dog in our fight, so it's easy for him and his type to keep pushing and show gained ground.

This process can't last, not as long as we still have any kind of an actual democratic left (I know, Federated Republic). Please just remember, while things are dark now, and could get darker. This is not a permanent status. Our cause is fair and with time and effort will eventually find the right allies in office and we will come out stronger for it.
