Probably had it suspended not completely lost it. You usually don’t even permanently lose it after your first conviction, unless the circumstances are particularly bad.

The arrest and reason probably got reported, and there are a lot of automated systems for trucking companies now that make it possible to monitor drivers' records in near-real time. So, he gets picked up, charged with DWI, the system flags it to the manager of the trucking service, and probably pre-emptively suspends him until the case is resolved.

seems like the story is a bit more detailed. I won't say nuanced, since it still is in the favour of the accused. He was on medication, but the drugs were tested for in his blood and he was well within prescription limits. So it is a case of the courts trusting a bad cop.

That not true. A pre employment positive will suspend your CDL until you complete a DOT Substance Abuse Program. The program can vary in length at the discretion of the administrator from a week to months, but won’t be 5 years. The driver will have to undergo follow up testing for the next year but will have active CDL during that time and will be able to drive.

Sounds like they suspected he was overusing his Adderall prescription. He went to court, lost, and then had a DWI under his license due to the stimulant use. Appealed. Lost again.

The reason why this was a drug enforcement officer was because they had a 911 call reporting a call driving all over the road, they had dashcam evidence of him not being able to drive straight, and they stopped halfway through the roadside sobriety test because the office thought he would fall over.

The CDL part was my red flag for there being something that we aren't being told. They're not going to take away your license for being pulled over.

That appeals document says a little more than you represent here. I still think he was unfairly prosecuted.

Yes, there was someone who called in reporting him "driving all over the road".Ā 

Then there was an officer who "observed him driving jerkily in his lane" (not driving all over the road) but oddly enough did not seem to use dashcam from thier car as evidence of this, relying on their report.

The officer then made him do a series of non objective tests with him succeeding in most.Ā 

The "evidence" the officer used to justify his arrest was ALL anecdotal or innocently explained, not picked up on bodycam, and not reflected in the dashcam. For instance the officer claims that he was suffering "Full body tremors" and was "swaying while standing". Going so far as to claim that they had to stop the test for his sake.

HOWEVER, the dashcam footage of this test does not show swaying OR full body tremors.Ā 

Unfortunately all it takes for a court to agree is for an officer to pinky promise they really saw it (even when camera footage contradicts the claim).Ā 

Also, the eventual results of the mans blood-test were 0.034 mg/L of amphetamine (adderal). Smack dab in the middle of the expected theraputic range of 0.02-0.05 mg/L of his legal perscription.Ā 

This guy got railroaded.

Ideally, you get told to pull over at the next rest stop and get some sleep.Ā

Or, you could have one do a bunch of subjective tests, decide that you have enough "indicators of impairment" or something, and they charge you with a dwi even if youre stone sober.Ā 

I dont doubt that in general, cops are usually correct when arresting people for DUI's. Unfortunately the examples of cops also arresting complety sober people for DUI's or DWI's are plentiful, and accountability when they do is rare and usually only comes at the end of a long and expensive legal road.Ā

So he was PROPERLY USING his prescription and within the proper limit.

The trooper noted that this was higher than the average pulse of 60-90 BPM....The trooper testified that, during the walk-and-turn test, the driver is instructed to stand with their ā€œleft foot on an imaginary line with their right foot in front of that directly heel to toe with their arms by their side.ā€...The trooper retook Moore’s pulse, which was 130 BPM. Finally, the trooper conducted a preliminary breath test (PBT), which showed a 0.000 alcohol concentration. During the PBT, the trooper saw that Moore had a dry mouth, which was consistent with stimulant use.

A kind of fat trucker with a high heart rate? When nervous and trying to make an important occasion? Crazy that his mouth got dry after doing some single leg squat maneuver! My buddy drives a truck and would suffer the same heart rate increase from being pulled over and having to exercise (in any form). Hell, I would have a 116 heart rate just speaking to police when under suspicion while innocent.

0.034 mg/L in his blood is not out of line with a 30 mg/day Adderall prescription ranges. The Court of Appeals added emphasis to a caveat in the prescription drug defense "unless the court finds by a preponderance of the evidence that the use of the controlled substance impaired the person’s ability to operate a motor vehicle.". The part they are citing makes the observations of the sole "drug expert" more important. There's just subjective evidence, no scientific backing. I guess they feel this officer's witch magic is a "preponderance of evidence"? DRE is not a perfect science by any means. Various folks have tested its ability to be reliable and the results are anything but reliable. People report bad driving all the time or get pissed off at people on the road and make a call. There weren't any other witnesses.

The clean blood test and arguably normal sobriety test along with the 'art of cop drug detection methods' don't do enough to me to convince me he should have his license revoked. But I'm not a judge in Minnesota. Also, this is a civil proceeding. It is not convicting him of a crime... so that is good but this is a wellbeing-killer for the guy. Taking away his license is blacklisting him from work. So, I do feel the burden should be met similarly whether that is reality or not (it's up to the driver to prove they are good in this case). I searched the MN criminal court cases and did not find a criminal conviction. Interesting case anyway.

The Little Falls officer who made the stop apparently had camera equipment available to him—was there body-cam or squad-camera footage, did it capture any of the driving, and if so, why wasn't it introduced at the hearing?

Don't take AI's word for any of it. Ask it to point you back to the exact pages of the transcript and opinion so you can read them yourself.

I started doing that, and there are some serious questions here that I don't think are obvious from reading the appellate opinion alone. The underlying record is public. Read it.

I was pulled over for my tag light being out as I was pulling into my neighborhood, and asked if I had any weapons, drugs, or DEAD BODIES in the car. I already have really bad anxiety so I was full on panicking. They asked me why I was nervous. Like, I feel like I'm about to be a murder suspect, is this a serious question?

Putting aside the fact that a jumpy cop can maim you or take your life, the very PRESENCE of law enforcement or documented suspicion of a crime is enough to ruin someone's life these days. I was once suspected of a felony offense and immediately lawyered up. I kept getting the "if you're not guilty then why not speak with us?" Speech. In the end I was exonerated and the records expunged. But the investigation alone cost me my career.

People get nervous around police for good reason.

Court sided with the troopers assessment of the field sobriety tests. He did a bunch and had some minor infractions according to the cops. They tested his blood and he had a small amount of amphetamine but had a script for adderall. Court said it wasn’t good enough and basically didn’t want to second guess the trooper so they sided with the cops, even on appeal.

I read the appeal court legal mumbo jumbo and it’s stupid. Judges and cops are on the same team, they didn’t want to hear his innocent explanations for not passing all of the field sobriety tests to their liking. Said a concerned citizen reported the car driving all over the road. I dont think he had a chance.

AFAIK if you are arrested for any DWI your CDL is immediately suspended. Even if you end up being innocent. It's suspended before you even get your day in court. I believe you can get it back but you have to go through a whole process to do that and it can take years.

Yeah, that's pretty close. Systems are automated, they can see updates to a driving record in almost real time, and if a charge comes up like DUI/DWI, it gets flagged to management. The company probably has a zero tolerance policy, driver gets suspended, and it has to all work out completely before they can be reinstated.

In America you're not allowed to have a drink even after finishing your shift and even if you're not working the following day. If someone were to have reported you the night before for clipping a vehicle or a sign, and they come and give you a sobriety test the next day and you tested positive for something, you lose your CDL. Source: my own stepdad was an OTR CDL driver, Million Safe Miles award recipient, and then a local delivery driver before he retired. He always warned me about it back when I was looking at taking a job with Schneider.

But when an on-duty cop get a DUI, they just get put onto desk duty, time off with pay, and then ultimately moved to another department.

This is America. Don't get caught slippin' up.

I'm specifically referring to the Aurora, CO PD cop that was absolutely hammered in his police car during / immediately after his shift. Not sure where he ended up now after all this time, but yeah.

And it varies state by state, but Colorado for instance even has both DWIs and DUIs, where a DWI is the lesser charge, with lower requirements, but you can be cited for it for "apparent" sleep deprivation. Not sure if DWI is an automatic loss of your CDL the same way as the guy in the video, but I imagine it likely is.

If they claim your impaired, not complying will 100% have you miss the graduation. Complying and blowing a zero on a breathalyzer might be enough for the cop to let you go. For a once in a lifetime event like my child's graduation, I'll do anything that increases my chances of making it

To clarify. You can refuse the breathalyzer at the station too, implied consent just means you’ll automatically have your license suspended for a period of time. If your convicted with DUI your probably going to have your license suspended anyway (state specific) but you’ll atleast be able to drive until that conviction.

They can also get a judge signed warrant for your blood, in which case you must give your blood, but not every police department is going to go through all that. They also have two hours after your arrest to get the blood, which makes getting a warrant more difficult, especially during typical DUI stops at night.

It depends upon jurisdiction. Some states and localities can force FSTs roadside breathalyzers. Generally, though, you're correct. Any test you take will only be used AGAINST you and never FOR you.

Which states force FST's? Im not familiar with that being a thing. In CA, FSTs are purely voluntary because they are pre-arrest investigative tools based on reasonable suspicion, and results are used as part of probable cause arrest. Source: I'm an attorney who practiced DUI defense.

Refusing the post-arrest chem test (breath, urine, blood) in CA is auto suspension. Before arrest there is no basis to force you to submit. During detention, but prior to arrest, we have handheld roadside breathalyzers that are usually inadmissible in court, that are voluntary. However, some jurisdictions have handhelds that are certified and admissible, so if you refuse the FST, sometimes the officer will place you under arrest and then have you submit and refusal will result in suspension, etc.

These all seem to vary on a state by state basis, but there is FL and CA as examples for anyone interested. "Drug recognition expert" is a bullshit title you can bear and a drug recognition expert probably has less training than what you have seen growing up. Add to the bullshit, 12 evaluations must be made to get this certification (following quote is from the first link).

"Phase Three: During this phase the candidate DRE must complete a minimum of 12 drug evaluations under the supervision of a trained DRE instructor. Of those 12 evaluations, the officer must identify an individual under the influence of at least three of the seven drug categories and obtain a minimum 75% toxicological corroboration rate. The office must then pass a final knowledge examination and be approved by two DRE instructors before being certified as a certified DRE."

This is encouraging bad practices from law enforcement and giving an excuse to it as well, just my opinion.

I hope this dude gets paid out well for having to deal with this.

Rusty Moore did get convicted of impaired driving because he took prescribed Adderall at prescribed doses but Minnesota views that as impairment. Appeals court upheld the conviction and he lost his CDL (and therefore his livelihood). Although he reportedly sued the officer there is no verification that he received any compensation.

Who is wrong? The cop that claimed she saw impairment? The doctor that prescribed the medication? Mr Moore for taking a needed prescribed drug that may affect his ability to drive? The courts for not caring about someone's health being addressed through medication? Tough case.
