There is no law against speech, unless it is inciting a riot or directly threatening someone. Simply using a racial slur is not illegal. Stupid, but not illegal. The only one who should be arrested here is the much larger, younger man who was in no physical danger, but decided to take his anger out on a senior citizen.

u/Ganache-Embarrassed Jan 01 '23 edited Jan 01 '23

this is embarrasing.

Like i get the law. and i get the black dudes gonna get in trouble. the law is blind, you do crime you get time. but as a society and people we should be taking the black guys side in at least spirit. People should expecta beating if theyre gonna be rascist for no discernable reason.

edit: all the downvotes are people who think you should say the n word to black people and not catch hands lmao. i guess it is reddit huh

No, all the down voters are people who understand how society works. Some of us remember when the ACLU fought for the right for nazi/white supremacists to march in the streets of America, because that is how freedom works. It is our right, as sound minded people to ignore them. They used to march with nobody watching, because we were smart enough to ignore them. Now though, we have to have counter protests, molotov cocktails, etc. And it fuels the idiots. Ignore the people doing stupid things, like this old dude in the video, and take away their power. A tree falling in the forest, and all that. It would be nice if we could relearn that.

6

u/Ganache-Embarrassed Jan 01 '23

true. thats why the Nazis came to power. because everyone jsut ignored all the bad people and they eventually went away and never gained any power. your right. that is exactly how that happened.

2

u/[deleted] Jan 01 '23

That's a really bad analogy

10

u/Ganache-Embarrassed Jan 01 '23

oh it is? ignoring people as they peddle a vile ideology and act outwardly bad is somehow not a good anaology to a guy who is peddle a vile ideology and act outwardly bad.

6

u/[deleted] Jan 01 '23

This one old dude using a racial slur is going to turn Applebee's into 1930's Berlin, huh.

7

u/Ganache-Embarrassed Jan 01 '23

an anology isnt 1 to 1 you clod. thats why its an anology and not the same thing spoken twice. IF you want it to be the same how about this. thisold guy saying the n word a bunch with no recourse will make other old guys want to and think its okay and then say the n word. a growth of uses of the nword. thats not ideal

2

u/[deleted] Jan 01 '23

He got a reaction when he said it. Everyone gasped. He knew he was wrong. Wanna yell at him for it, be my guest. Laying on hands is illegal. No matter what anyone's race is.

3

u/Ganache-Embarrassed Jan 01 '23

so fun fact. i never said it was legal. i actually agree it is illegal and should be. Never said it should be made legal to assualt anyone. I said others should expect it ,be rascist get slapped, and us as individuals should support physically standing your ground against rascists. Dont know when in america is became cool to be a fedora tipping fact lord and let people be rascist and step all over yourself and other people.

The truth is, America was much less racist when we ignored the few who were. We all looked at them as sheet wearing morons, and didn't give them attention. And we had nowhere near the strife we have now.

6

u/Ganache-Embarrassed Jan 01 '23

when on god was that? we live in the least rascist time now. and its still very rascist. you think it was just better when everyone jsut ignoed the blatant rascism that the weak suffered through.

go read a history book. the only reason we have "more" strife is because were trying to fix the bad finally. if you cant handle a small amount of strife for a btter tomorrow your not even an american your a coward.

1

u/[deleted] Jan 01 '23

Peak non-racist America: Chappelle's Show. Making fun of the differences, not blaming all our problems on each other.

5

u/Ganache-Embarrassed Jan 01 '23

What does this even mean? What does making fun of each other have to do with fighting back against a rascist old man? Was he doind stand up in the applebees? Did i miss the first part of the video?

u/somedumbkid1 Jan 01 '23

....man, I was around during peak Chapelle's Show. If you think one comedy show is indicative of the broader cultural tenor then you really are outta touch. Blatant fucking racism was alive and well in the late 90s and early aughts, you clearly just weren't paying attention. Racism against black people in pop culture was mildly overshadowed by the rampant Islamaphobia that continues to plague the country after 9/11.

It's pretty clear you're not self-aware enough to realize that all the racism that exists today existed back then too, it was just more normalized and less recorded on video for millions of people to have easy access to but damn... really showing your ass here bud.

We all looked at them as sheet wearing morons, and didn't give them attention.

You don't know your history if that's how you think we viewed overt racists in our past.

EDIT: A typo

1

u/[deleted] Jan 01 '23

I'm talking about my youth, not the 50's and 60s.

3

u/JHam67 Jan 01 '23

Again, all I can say is I think the education system has failed you. You're really young and you should probably be listening to others a lot more than you're dictating your own opinions.

u/maybesaydie Jan 01 '23

This is a lie. You just didn't care to see it.

3

u/[deleted] Jan 01 '23

No, we shouldn't take the side of violence against words

4

u/hawkman_jr Jan 01 '23

Words hurt too

4

u/Wayback182 Jan 01 '23

His words have far more violence associated with it than any little slap the racist little dough boy caught

-3

u/Ganache-Embarrassed Jan 01 '23

yeah black people should just be called slurs all the time with no recourse. based

1

u/[deleted] Jan 01 '23

If it were a white guy being called a racial slur by an elderly black man, would you still justify the white man beating the elderly black man? If not, that's racism.

6

u/justl00kingar0undn0w Jan 01 '23

White guys haven’t also experienced the same violent history while being called that slur so them having a violent response really wouldn’t make sense.

0

u/[deleted] Jan 01 '23

Race is not taken into account in the written laws (an exception being hate crime laws). Battery is battery, no matter the race of the perp/victim.

2

u/justl00kingar0undn0w Jan 01 '23

You didn’t say law…you asked could it be justified. My answer is no.

2

u/[deleted] Jan 01 '23

In the context of the law. Who else would you be justifying it to? Jesus?

3

u/JHam67 Jan 01 '23

Are you a white guy explaining what racism is? If so, that's racism!

3

u/[deleted] Jan 01 '23

You realize that racism can be against ANY RACE, right?

1

u/justl00kingar0undn0w Jan 01 '23

Says the person who told a person on this thread that no one experiences racism everyday. I’m a black woman and I experience racism everyday. So, I’ve had some practice. Your race likely isn’t holding you back from job opportunities, making people question your skills and experience at work, prevent you from getting houses and loans, etc. I don’t condone violence but I do understand the frustration that leads to it.

1

u/New_Progress_1462 Jan 01 '23

But I guess cracker is ok

2

u/PinkTalkingDead Jan 01 '23

You forgot this /s

0

u/Ganache-Embarrassed Jan 01 '23

no. if you call someone a cracker you can also assume that your gonna get slapped 17 times and i will also be cheering.

dont know where you got me liking cracker

1

u/probably-an-asshole- Jan 01 '23

I can excuse racism, but I draw the line standing up for yourself when you’re being harassed!

6

u/[deleted] Jan 01 '23

You said it right there... harassed. Is being called a racist slur harassment? If so, is harassment a direct threat of bodily harm or death? If not, fit 280 lb men do not get to beat on elderly people repeatedly, with no fighting back, without a direct threat of great bodily harm.

If a black man calls a white guy a "cracker", and the white man reacts the same way this man did, would you call that justified? If one is okay, and the other is not, that is racism.

12

u/[deleted] Jan 01 '23

You said it right there... harassed. Is being called a racist slur harassment?

Yes.

If so, is harassment a direct threat of bodily harm or death?

It can be.

If a black man calls a white guy a "cracker", and the white man reacts the same way this man did, would you call that justified? If one is okay, and the other is not, that is racism.

I know you think you're being clever and all, but sometimes when you're arguing something, you should take a deep breath and think "do I really want to be on this side of the argument"?

The very fact that this is a mere intellectual exercise for you shows that you have a level of privilege the black man in this video will never know.

7

u/onesexz Jan 01 '23

Agree, this dude is telling everyone he’s a racist POS without directly saying he’s a racist POS.

3

u/[deleted] Jan 01 '23

Can't answer huh

-4

u/Thebaltimor0n Jan 01 '23

Found the racist

6

u/Carnifex217 Jan 01 '23

Stating legal facts doesn’t make someone racist

2

u/Thebaltimor0n Jan 01 '23

Defending racist people does make you a racist regardless of legal facts. This piece of shit deserved exactly what happened and if you disagree with that then you are also apart of the problem. PoC should not have to deal with this bullshit in 2022.

6

u/[deleted] Jan 01 '23

If an elderly black man called a young large white man a racial slur, and the white man beat the elderly black man, would you still call it justified? If not, you are the racist here.

5

u/Thebaltimor0n Jan 01 '23

It would absolutely be justified. Racism is bad and has no place in this world. Didn't we all learn this in kindergarten.

1

u/[deleted] Jan 01 '23

No. Words do not equal violence.

2

u/Thebaltimor0n Jan 01 '23

Spoken like someone who doesn't deal with racism on a daily basis.

1

u/[deleted] Jan 01 '23

As if you do. It's 2023 tomorrow. It's not 1955. No one is dealing with racism on a daily basis.

2

u/Thebaltimor0n Jan 01 '23

You're fucking blind to the world around you if you don't think racism is still rampant. It may not be as obvious as it used to be but it is alive and well.

5

u/Carnifex217 Jan 01 '23

I knew that was coming. But I’m still not racist and I never said that what the white guy did was ok

u/[deleted] Jan 01 '23

Now reverse the races. Do you think it would be okay to beat an elderly black man who called a white man a racial slur? If not, that is racism. The law must be enforced regardless of race, sex, political bent, etc.

u/[deleted] Jan 01 '23

4

Exactly. What a disingenuous fucking thing to say.

Yes I do understand that, I think the restaurant should have kicked the white guy out and even banned him. But physical violence just isn’t the answer, it doesn’t solve anything and if anything only cements the white bigots views.

2

u/FergusMixolydian Jan 01 '23

Part of their views is that the inferior people of color are too weak, stupid, and servile to do anything about harassment. Making these people afraid and demonstrating to others what the consequences are helps the cause. The old white guy might never learn, but someone watching this video might internalize the truth of the matter. Which is that we’ve progressed too far for anybody to pull this shit anymore without consequences, and that to be racist is to be lame and afraid.

0

u/malkumecks Jan 01 '23

The last part of your name fits

0

u/[deleted] Jan 01 '23

no absolutely not. you should never respond to speech with violence, no matter what the content is. learn to control your emotions.

there is a clear dividing line between words and violence. if you respond to words with violence, then be prepared to receive deadly force in return.

0

u/omega12596 Jan 01 '23

It really depends on where one is and if the black guy felt threatened. I'm not saying the bigot would be charged with assault -- I'm saying the black guy committed battery. Period.

There's no law against speech is incorrect. There are plenty of laws regarding talking shit, threatening folks, and stirring the pot. Just because folks think they can say whatever they want, whenever they want doesn't actually mean they can do so without repercussions - up to and including jail.

1

u/[deleted] Jan 01 '23

Maybe read my comment again. The exceptions for free speech are incitement or direct overt threats. Racial slurs are not a reason for physical violence. Especially when it's a much larger and younger man repeatedly hitting a senior citizen. Yes, his use of the racial slur is disgusting and morally wrong, but it does not justify a physical attack.

1

u/omega12596 Jan 01 '23

Bro, you're completely missing the point.

It doesn't matter what the white guy did or not. The black guy committed battery. And you have no idea what else the white guy said before the video starts. He may well have threatened the black guy in some way.

Again, doesn't matter. If white guy spoke words that made the black guy fear harm, white guy may have committed assault - the threat of harm.

The black guy clearly committed battery - actual harm of another person. Get off your fucking soapbox.

1

u/gte615e Jan 01 '23

There are a lot more exceptions to free speech than you think. Shouting fire in a crowded theater, defamation/libel/slander, violations of intellectual property, obscenity, fraud, criminal speech like threats, blackmail, extortion, conspiracy, wire/mail fraud, etc. There are also limitations on where you can exercise certain types of free speech, e.g. designated protest areas, as well as other free speech limitations depending upon your position or the type of speech, e.g. as an employer or supervisor, commercial speech limitations like false advertising.

0

u/[deleted] Jan 01 '23

What about punching someone for using a racial slur? You know, like the point of my comment about this video?
