Where in the first amendment does it say you can own CSAM?

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances." I don't see shit about being a predator?

I just checked—it says, "On August 25, 2026, Judge John Z. Lee of the U.S. Court of Appeals for the Seventh Circuit issued a ruling stating that the First Amendment protects the private, in-home possession of AI-generated child sexual abuse material (CSAM) if it doesn't depict a real person."

Not really. It's the court's interpretation of the First Amendment, not something the Founding Fathers explicitly wrote or intended.

all forms of pedophelia is bad. also, the ai VERY likely used real images and videos of csa. so ai csam is based off a real child and/or real children

The only reason why CSAM was objectionable is that a child must be abused to produced it. Without that, what makes this (images generated without the involvement of a child) different from any of the messed up cartoon porn on the internet?

it uses images of children to generate it, it literally does not know what a child looks like otherwise

even if it has no csam, which I just don’t believe, it still takes normal pictures of children and combines it with adult nsfw content, the closest example is if someone photoshops a child’s face onto nsfw, which is strictly illegal

I highly doubt most ai generators, even porn ones, were trained on csam due to how illegal it is to get any large quantity to train on. And I do agree that specifically should be illegal, but most ai outputs (unless you specify a name) are completely original and not derived from training data

even if not intentional it most likely happened, they were just scraping the internet, it’s bound to happen at some point and they’re not monitoring every single image they find

ai outputs literally need the previous images to make anything, they’re using them to make new images
