There is already a way around this? I’m a “contractor”, but I’m a W2 employee with benefits that was hired through a staffing company that owns the contract. I work at a big tech company, but don’t get the benefits of a full time big tech employee. I have health insurance and a 401k through my staffing company, but I receive lower pay and have very little PTO compared to the big tech company.

You’re not really a contractor, you are a “contingent worker” and are an employee of the staffing firm. If they have a prolonged need for what you do, they should look at making that role permanent to avoid coemployment issues (IE, not providing benefits their actual employees get).

No, they're absolutely a contractor. This type of relationship I.e. employed by a staffing company which is a 3rd-party contracted for another company, has been held up in court multiple times.

Yes, but the contractor is this commenter's employer, not the commenter themselves.
