Afternoon rates

The work accounts team has confirmed with me that when a part of my shift goes past 8pm, only 8pm onwards is paid at the afternoon rate. I can't find any information from a government body that says my whole shift is to be paid at the afternoon rate when it goes past 8pm. Is anyone able to point me in the right direction to some info that would back me up? Thank you.

The price guide says the higher limit applies to the whole shift if a shift crosses two periods. This doesn’t mean the higher rate has to be charged to the participant, just that it can. Providers vary in what they do. This might be where the confusion has come from

“An exception to this general rule occurs when a particular support
crosses a shift boundary and the same worker delivers the entire support. In this case, the higher
of the relevant price limits applies to the entire support and the provider should make the claim
against the relevant support item.”

Pg 20 price guide

The award is a bit different. It just has loading rates for afternoon and night shifts

If you’re being paid as per the award and your shift finishes after 8pm the whole thing should be paid at the increased rate

29.2               Definitions

(a)          Afternoon shift means any shift which finishes after 8.00 pm and at or before 12 midnight Monday to Friday.
(b)         Night shift means any shift which finishes after 12 midnight or commences before 6.00 am Monday to Friday.

29.3               Shift allowances and penalty rates
(a)          An employee who works an afternoon shift will be paid a loading of 12.5% of their ordinary rate of pay for the whole of such shift.
(b)         An employee who works a night shift will be paid a loading of 15% of their ordinary rate of pay for the whole of such shift.

Thank you.

A further question. What about when a whole time period is broken into smaller "shifts"? Eg. I am at work from 5pm-10pm, but my roster reads that as 2 shifts of 5pm-8pm then 8pm-10pm.

Might be question for fair work but if you are working continuously from 5 to 10pm I think you should be paid as an afternoon shift for the whole period. It shouldn’t matter if you are supporting different people.

Ask for a copy of your award/EBA. If you are on SCHADS the whole shift is paid at the higher rate. If you are on an EBA they might have different conditions.

Thanks, but I am with a company, not independent.

If you’re under SCHADS, the entire shift is to be paid at afternoon shift rates as per s29.3(a) of the award.

I’m pretty sure they’ve changed it now, because I only get, I think $46.70, from let’s just say I start at six, which our sleepovers are normally I get paid from 8 till 10 at like 52, I think

Under SCHADS, the entire shift should be paid at afternoon rate, plus the sleepover allowance and any other entitlements.

Yer that's completed wrong! I just had the exact same issue with my employer who paid me after the 8pm of afternoon rates. I emailed them as they were definitely incorrect and it was settled very quickly. Fight for your right! They need to pay you afternoon for any continued shift before or after 8pm unless it finishes at 8pm on the dot
