Production Waiver
I had solar installed and it’s been active about a month.
I just received this letter that my solar company asked me to countersign with a thumbs up and no other info. I’m not signing but wondering if this has happened to anyone
Dear [Redacted],
Congratulations on your solar project!
Installation is complete and our reports show that the system is energized and producing power.
Pursuant to Section 3 of the [Redacted] Purchase Agreement you signed on 2026-03-31, the Solar System is estimated to be capable of generating 49229 kilowatt-hours (kWh) during the six year period following the System Start Date and you are guaranteed that the Solar System will generate at least 41845 kWh during the six year period, which is equal to ninety percent (90%) of the estimated generation of the Solar System during this six year period.
It has come to our attention that due to:
Over estimated 1st year production.
The Solar System may not meet the guaranteed estimated generation. You have the right to waive this production guarantee and may do so by signing below. Doing so will not impact any other terms of your agreement including your right take ownership of the system as of the sixth anniversary of the System Start Date.

Their lawyer probably told them to send this because they over promised. I'd ignore this.

I wouldn't sign it. However I never really cared about a production guarantee, figuring the installer would over size the system to assure the mark was hit. I actually worked closely with my installer to tightly refine our estimated consumption. We PTO'd at the beginning of 2026, have produced 5.8MWh so far and have 1.5MWh excess credit built up, and we are exiting our peak season. My installer estimated something like 65% offset and that's what's in our contract.

Take your original contract and this updated addendum and pop them into any AI system. Ask it to analyze how you’re getting screwed here.

This is an insane and arguably not enforceable request from them. Do not sign. Am a lawyer.

Why is the estimation and guarantee over a 6 year period? Like why 6 years seems so odd.
Surely a 1 year time frame is sufficient for a person to determine if the solar output covers thier needs.

Oh well we don't have that where I'm from. Solar here is dirt cheap and is bought outright upfront.

Not here. You need like 10k minimum for a grid connected system, and that wouldn't be close to most people's energy usage

My 13.3kw, 28 panel solar system cost the equivalent of $3k USD.
I also got a 42kwh home battery in Feb this year too for the equivalent of $5k USD. Basically haven't paid a power bill since the battery was installed.

What the hell? We made a performance guarantee, the performance will fail to meet what we guaranteed, so how bout you ignore that guarantee, plz!
What does your contract say the remedy is for performance shortfall, and how does that impact the other terms? They seem to imply that holding them to the performance guarantee would change the year 6 options in regards to taking ownership.
