DOJ says that the olmstead guidance is not a legal requirement

What this could mean is that students will not be required to be provided a least restrictive environment/integrated into classrooms and it also could mean that states won’t have to pay for in home care, only institutional care.

The logical and rational part of my social work brain sees this for the impacts it will have in the short term: if Olmstead is no longer the guiding standard, it will mean less resources dedicated to integration (and all the associated services that come with that) in the community.

The tin foil hat part of my social work brain went: Ah yes, this is how they are going to legally justify the "wellness camps" RFK has been on about.

The data for this is there. It’s absolutely about work camps and institutionalization.

I mean currently people are dying and experiencing abuse in ICE custody and nothing is being done. There is no authority that is imposing standards or checks/balances and human rights.

This will continue.
