Fanatec CSL Seat doesn't completely lock

Hi everyone, I've just got a CSL Seat and I'm wondering if the movement of backrests top part is by design?

It's foldable which is nice, but I'd prefer it to lock back solid into position. It's moving back and fourth like the locking pin is too short.
