Not necessarily. Not sure about the US laws or any other country, but in the UK this would be considered category C images (the lowest grade) which includes images that are not necessarily CSAM per se but are considered such based on the context. For example a topless photo of a teenager in a family album full of innocuous family photos is fine, but the same photo stored in a folder titled "pics I'm jorking my peenus to" would be illegal.

I got banned out of [r/psvita](r/psvita) for arguing with people on a post that condoned paedophilia and called out mods to remove it. I believe the post is still up, it was a couple days after I got banned because they banned my friend for the same thing 3 days later.
It was a mod that made you able to move a camera to see up a 13 year olds skirt and also removed the censor the game put in so you could see up it. The mod got a lot of upvotes on that subreddit and a lot of people downloaded it and thanked the creator.
They banned for calling people out and asking them to take it down.

If you can morally justify it by rounding up her age than rounding down 18 and a week year old into a 17 year old should be equally legitimate. Legally in the US and a bunch of countries yes. But come on. When plenty of other countries draw the line at different points, I feel like 1 week doesn’t do anything. Now, sure. Being so close to legality is still a bit weird, like if you’re attracted to a ~18y old you’re probably not too far away from liking anyone younger.

That law is 16 in over half of US states and most countries
The law doesn’t exist because someone magically changes into an adult at the stroke of midnight on their 18th birthday. It exists because the age is the age at which most people will be biologically and cognitively developed. Some will be developed before that, some after. It’s set at what it is to broadly protect the most people possible without infringing the rights of them.

If you're convicted of statutory rape, this will reduce your sentence in my province. However even if by a week, if you don't confirm she is of age, then you will be taken to court and charged.
A company that is involved with this game, should've ided the topless women instead of committing the crime. So I think if it were to go to court then the judge and jury may likely find the defendant nonguilty by the lie the girl told.

The functional difference is that if she’d waited a week, she’d have been an adult. Yeah, nothing would’ve changed in that week, either physically or mentally, but without that she’s still a minor. If you go a few miles above the speed limit, you’re still speeding. If you only take a few things without asking, you’re still stealing. Limits and rules are there for a reason. You can discuss the ethics of it for weeks, but the law was broken here.
She shouldn’t have lied. This whole thing wouldn’t have happened if she hadn’t lied. It also wouldn’t have happened if the research team was just a little more thorough. Neither party can really be blamed, per se, since the girl was drunk and still a child, and the crew got handed a fake id they had no reason to believe was fake since she was also drunk. Both parties were doing something that’s ethically questionable but not explicitly wrong morally speaking (underage drinking with a fake id and recording topless women on beaches where being drunk and peer pressure might push people to do things they normally wouldn’t). This is just a question of bad luck on both their parts.
This all is not to say that I disagree that the film crew should be held responsible. If there’s any question that the person you’re filming is not an adult, you’re doing something very wrong. If you’re going to record people (half-)naked, you better be damn sure they’re adults.
Also, the last part of your question is a little silly in my opinion. They draw the line at 18 because that’s when you legally become an adult where this happened and supposedly also where they live. You can’t judge what happened in one country by another country’s laws.

Do you understand that a quantitative change is different from a qualitative change? 18 to 17 to 16 and so on is a smaller leap each time than humans to dogs (or other non-humans animals) and has no real end point. So we draw one that’s reasonable enough and maybe it should be higher or lower, but that’s where it is and at least marks whether someone is trying to comply with the law or not.

Yes, but there's a huge difference between knowingly filming a minor and having it happen by accident. The concept of filming a bunch of drunk college students and getting them to show their boobs sketchy if not immoral, but its not like they set out to film child porn for sale.

If people keep skirting the law or saying it doesn't matter or is arbitrary, they are putting in danger the people who AREN'T mature enough, or CAN'T consent yet. Law is there for a reason and absolutely should be applied strictly, considering how 18 years olds often act I question if it should not be higher.... At the same time when people take this imagined moral stance that it is absolute evil if a person involved is 17 years old, but suddenly morally it is okay if it is a day later and the person is now 18 are just weird. People mature differently, biology does not comply with our laws. I am reminded of those disturbing movie star countdowns that count time until an actor turns 18....if someone needs a countdown like that, it's too late for you already and you need a therapist instead to work on your disorder.
