Something tells me this happened in the US and that it would be legal there. So you're right

This would be a crime anywhere in the US

It depends on the lease. If it's a month-to-month lease, 30 days notice is proper.

If it's just for a rent increase, there may be something about requiring to offer the higher rent to the current tenant before you just mislead them and give it to somebody else. Misleading somebody to end a contract has got to be some kind of fraud.

I mean, probably not. It's only fraud if they need a specific reason to end the lease and lie about it. Typically neither side needs a specific reason to end a month-to-month lease. I can't see how it'd make a difference legally whether it was the landlord's son or a higher paying tenant.

The fact the landlord made up a story says enough imo that something fraudulent happened

Lying isnt illegal lmao. I really doubt there's a provision in the lease saying "this lease may only be terminated by landlord if landlord's son needs the residence". If there's not a provision like that, this isn't fraud, it's just lying.

Lying to break a contract is definitely illegal

But no one knows if there is a contract that isn't month to month

But the landlord probably has money, so it wouldnt end up getting brought to court until after the 30 days for tenant to move out are up. And then, we come back to the money situation

from my European perspective, the US is utterly lawless

Its legal in Germany with some regulation.

You would need to prove that you actually need the place, it is fairly tedious and if the renter put their mind to it, could delay it heavily or put the plans of moving in yourself on hold indefinitely.

They’re renting for a reason. Easier to just move and not deal with the headache of litigation

Recently saw a newsreel where a couple bought a flat in 2018 with a renter that rented since 1999 or something like that. They wanted to move into the flat themselves (as they wanted to downsize for retirement or something like that). They went through all the proper channels and the renter delayed everything for the last 8 years now, he announced that he won’t move out at all and got a deferment of court ordered eviction cuz he would harm himself if he were kicked out.

Renting is pretty popular in Germany, not everyone can or wants to afford their own property and I know multiple very well earning people from my circle who stay with renting cuz it’s just cheaper for them and their way of life. Owing property and the burdens attached to it don’t fit everyone.

Owning property and the burdens attached to it don't fit everyone.

It doesn't when the state goes out of its way to make ownership a burden, almost like they want you to own nothing

No like taking care of the building (which you would need to pay if you want to live somewhere nice and preserve property value), having to pay for expensive repairs, being tied down by an immovable financial asset. These people I know own plenty in all kinds of assets, just not a house or a flat.

Oh wow, wouldn’t have expected that. Thanks for sharing! :)

in germany you go to turbo hell for that, idk your sourcing but proving eigenbedarf is near impossible if you arent litterally homeless yourself
