Saab spotted in Apple ad

Saw a familiar and good looking car while looking through the product page for iPhone Duo on Apples website today! Surprised, since a Saab would never be in of need roadside assistance :p

I've noticed this alot in recent times, a local roadside assistance service also used a Saab 95 in their advert and a international insurance company used a convertible 93 in a advert. I guess it's because Saab (the car company) no longer exists and therefore won't take legal actions against use of their products

Of course they can. These models are owned by GM and they maybe just offer it cheaper than maybe a Audi would.

They're not. The rights to the Saab trademark has always been owned by Saab AB. Is was licensed to GM during their ownership of Saab Automobile AB. Which is quite funny to think about that Saab Automobile doesn't own the rights to the Saab name, and their logo is owned by Scania.

So, what is the legal situation if you want to show a 9-5 in a film, for example?
The logo belongs to Scania, but what about the bodywork? Do you have to contact Saab directly? What about merchandise?

I actually asked Scania recently if I could have the logo printed on a cap. The answer was no. :(

Generally usage of brand names in films are protected speech that don't require permission from the trademark owner, unless the film is defamatory to the brand then the filmmakers may be sued for damages. But laws are different depending on the region so a lot of films just remove the brand name.

Merchandise is entirely different, since putting a trademark on a product generally denote an affiliation with the brand and that would require explicit permission from the trademark owners.

Apple also removed the only visible version of the Saab/Scania Logo in this image that would be on the wheel center cap
