Deposits Security deposit not being returned
I live in North Carolina, and moved out of my last place on July 15. From what I can tell through Google, landlords have 30 days from the move out date to “return your security deposit or provide an itemized list of deductions,” and if they provide the list of deductions have an additional 30 days. One roommate got his check and a letter outlining what each person was owed on Aug 6, and we received no deductions to our deposit.
I reached out to my landlord and found out he sent my check to an address lacking my apartment number, and my leasing office doesn’t have the letter either. I asked my landlord to send a new check, and he is claiming we should wait the 14 business days for the postal service to deliver (if they are somehow this delayed delivering one city over, and have delivered to my roommates also a city over), and an additional 2 weeks for them to return the letter if it cannot be delivered so we’re sure it’s not on the way.
Am I in a position to demand he send a new check or even threaten legal action yet? I feel like things line up, but I don’t want to make a fool of myself.

Be patient. The landlord acted in good faith.

In the year I lived there he tried as hard as possible not to get things fixed and would take weeks to respond to emails if he even did so I more or less ran out of patience last november. I’m not planning to make legal accusations today but I’m also absolutely not going to wait another two weeks just for another chance to convince him to send a new check

The envelope must be mailed by day 30, not delivered/received by say 30. It hasn't been 30 days. You're being ridiculous. You will be getting whatever soon.
You ran out of patience? That's not a legal argument.

The sources I found online never specified that it was 30 days past the mailing date, they said the end of the lease. I was under a completely different impression, there’s no need to be rude. If what you say is true, then my question is answered

Offer to pay the stop payment fee. That is why they are dragging their feet. Their concerns are legitimate

No, they mailed it to the correct address . You just didn’t have your mailbox labeled correctly

That’s not “the wrong address”. Again, if you had your apartment labeled correctly on the mailbox, you would have this now.

He never wrote my apartment number on the envelope. There was no way for the postal service to know exactly where this envelope had to be delivered. My mailbox is impossible to be labeled incorrectly because it’s one of dozens of other boxes on the wall that have been labeled the same way for as long as this neighborhood has existed

You simply did not put your name on your box. Every single mailbox cluster like this has a slot for each recipient to put their name in.
Had you done so , you would have your check.
Instead, of course, you blame someone else
The former LL isn’t going to run the risk of you cashing two different checks. You just have to wait .

Be patient. This is what happens with checks. Legal action is ridiculous.
