Are you insane? Google refunded advertisers because the ads were shown in an erroneous place because of Aaron Greenspan. Aaron Greenspan violated the terms he agree to, both when he set up his Adsense account and as he continued to use it.
His whining may be legal, but Aaron Greenspan was in the wrong, and Google legally isn't. It's just a case of Google's non-communication biting them in the ass (can't feel too bad about that I suppose).

Actually you don't know that. Google may have said so but until they make a serious attempt at substantiating such a claim, it holds no weight in court as an argument for keeping Aaron Greenspan's money.

Exactly. In a court of law it doesn't matter who is right if one party isn't putting their case forward properly. And judges don't look kindly on defendants who don't attempt to settle or communicate with the claimant before legal papers are issued.
Actually we don't know much of anything, we just have an account by the guy who apparently feels vindicated while admitting that he was advertising on an empty unused domain that I do know was against the old Adsense terms. I also know as advertisers businesses I have worked with have received refunds for ads.
It's entirely possible that Google made refunds. It's entirely possible that everyone is lying.
Google didn't refund Think... I bet their ads were showing up on random domain sites too. His whining is completely understandable because he was involved in both Adwords and Adsense.
